United Industries has agreed to pay $2.5 million to resolve claims that Spectracide herbicide’s labeling is mislabeled as being “concentrated” despite the products not being as effective when diluted.
The settlement will benefit consumers who purchased any herbicide in concentrate form sold under the Spectracide trademark between Sept. 21, 2013 and Nov. 1, 2019.
Plaintiff Gregory Arthur filed his Spectracide class action in September 2017, claiming that the herbicide products only worked on “newly emerged weeds” when diluted, so claims that the “concentrated” products could make a certain number of gallons of herbicide were false.
Arthur was later joined by other consumers who brought similar claims in amended complaints. Spectracide manufacturer United Industries Corporation tried to dismiss the class action against them, but their attempts were blocked in March 2018.
United Industries has since agreed to settle the Spectracide class action against them by paying $2.5 million and making changes to their labeling. The company has not admitted any wrongdoing by settling the claims against them.
Under the settlement, consumers will be able to collect $6.25 per each product they purchased. Each household can claim up to four products, for a maximum payment of $25 per household.
When filing a claim for payment form the settlement, Class Members should provide receipts and other documentation if they have such proof of purchase. If consumers do not have a receipt from their purchase, they can provide the dates and locations of purchases instead.
In order to benefit from the settlement, Class Members need to file a valid Claim Form by Jan. 20, 2020. The deadline for exclusion and objection is also Jan. 20, 2020. The final approval hearing for the settlement is scheduled for Feb. 24, 2020.
Who’s Eligible
Consumers who purchased any herbicide in concentrate form sold under the Spectracide trademark between Sept. 21, 2013 and Nov. 1, 2019.
Potential Award
$6.25 per eligible product, with up to four claims allowed per household (maximum of $25 in compensation).
Proof of Purchase
Receipts from purchases OR the dates and locations of Spectracide purchases.
