Mililani Mauka homes in Hawaii may not have high wind protection

Hawaii homeowners have secured a $10 million settlement resolving claims that Mililani Mauka homes on the Island of Oahu were installed with high wind protection systems that didn’t satisfy certain building codes.

Class Members include individuals, as well as entities and homeowners’ associations, who own homes in the Mililani Mauka housing development located in Honolulu. The homes must have been constructed on or after July 20, 2001 and had high wind protection systems installed.

Lead plaintiffs alleged that the high wind protection systems installed in homes in the Mililani Mauka housing development did not comply with applicable building codes.

The Mililani Mauka class action lawsuit alleged the builder, Castle & Cooke, used insufficient high wind protection systems in all of the homes in the development.

The plaintiffs lodged a related class action lawsuit over the brass fittings used by Castle & Cooke in the construction of the homes that settled for $30 million.

Mililani Mauka is a relatively new housing development located in Central Oahu, Hawaii. According to Hawaii Living, the homes are more modern and centrally located next to shopping, parks, and golf courses. The homes range from three to four bedrooms and feature lush tropical landscaping

Castle & Cooke denied the claims in the Mililani Mauka wind protection class action lawsuit, maintaining that the homes were built in compliance with the code.

Castle & Cooke agreed to pay $10 million to end the allegations. Nearly $6 million of that amount will be divided among Class Members. Payments are estimated to be approximately $2,500.

To make a claim in the Mililani Mauka homes wind protection class action lawsuit, Class Members need only return a Form W-9 after receiving the Notice of final approval of the settlement in the mail. The Form W-9 can be submitted online or by mail.

The deadline to opt out of or object to the class action settlement is June 15, 2019.

Who’s Eligible

Class Members include “individual and entity homeowners who on the date of Final Order and Judgment own homes whose construction was completed on or after July 20, 2001 with wind protection systems in the housing development known as Mililani Mauka, located in the City and County of Honolulu, Island of Oahu, and all homeowners associations whose members consist of such individual and entity homeowners.”
