A $1.4 million settlement has been reached to resolve claims that YouFit violated TCPA with unsolicited text messages.

The settlement will benefit individuals who received telemarketing text messages from YouFit between July 25, 2014 and May 15, 2018 despite not being members of YouFit and not consenting to the text messages.

Plaintiff Cydney Halperin filed her class action lawsuit against YouFit Health Clubs LLC in July 2018. Halperin claimed that YouFit sent unsolicited telemarketing text messages. Halperin allegedly received two spam texts from YouFit in May 2018 advertising their $0 down deal.

According to the spam text class action, YouFit’s telemarketing texts violated the Telephone Consumer Protection Act. The TCPA is a federal law that protects consumers from unsolicited telemarketing calls, texts, and faxes. If a consumer hasn’t consented to receiving these communications, businesses are not allowed to send them – regardless of any pre-existing business arrangement.

YouFit has not admitted any wrongdoing by choosing to settle the case against them. Instead, the company agreed to pay over $1.4 million to avoid the costs and risks of continuing litigation.

The settlement will provide a cash payment of $7.50 to each Class Member. In order to receive compensation from the settlement, Class Members need to file a valid claim by Nov. 15, 2019.

The deadline for exclusion and objection is Oct. 2, 2019. The final approval hearing for the settlement is scheduled for Nov. 1, 2019.

Individuals who received telemarketing text messages from YouFit between July 25, 2014 and May 15, 2018 despite not being members of YouFit and not consenting to the text messages.

    Wow, $7.50 and the attorneys probably got $350.00 or more. Don’t people realize that you are only making attorneys rich by doing these things? They never benefit the individual.
