Walmart class action alleges fruit cups falsely advertised as containing 100% juice

Plaintiff Dena Fields has filed a class action lawsuit against Walmart, claiming the company is not telling the truth on the packaging of its Great Value mixed fruit cups because it is not “mixed fruit in 100% juice” as the packaging states.

Instead, the fruit cups include added water along with other additives, such as natural flavors and ascorbic acid, according to the Walmart class action.

“The representations that the mixed fruit is served ‘in 100% juice’ is false, deceptive, and misleading, because instead of fruit served only in juice, consumers get other unexpected ingredients, revealed by the fine print of the ingredient list on the bottom of the package,” the Walmart fruit cups class action claims.

The class action cites studies that show additives in food are one of their top concerns about food, above foodborne illnesses. Another study showed that more than half of Americans believe additives can pose serious health risks, the class action states. 

Additives to improve shelf life, flavor or color can be bad for consumers’ health, class action claims

Foods that are filled with additives to improve color, taste and shelf life can be bad for consumers, the Walmart fruit cup class action states.

The proposed Walmart class action involves those who purchased the mixed fruit cups in Florida with claims of violating Florida’s Deceptive and Fair Trade Practices Act and its False and Misleading Advertising law along with breach of express warranty and fraud.

Dole recently agreed to pay over $4.3 million as part of a class action lawsuit settlement to resolve claims it falsely advertised its fruit cups as containing “100% juice” — and no proof of purchase is required for consumers to benefit.
