Trader Joe’s has agreed to pay $1.3 million to end class action allegations that certain canned tuna products sold under the store-brand label were underfilled.
U.S. consumers who purchased Trader Joe’s Tuna between Jan. 5, 2012 and March 2, 2020 could get cash from this class action settlement.
The following products are covered in the Trader Joe’s settlement: 5 oz. Trader Joe’s Albacore Tuna in Water Salt Added; 5 oz. Trader Joe’s Albacore Tuna in Water Half Salt; 5 oz. Trader Joe’s Albacore Tuna in Water No Salt Added; 5 oz. Trader Joe’s Albacore Tuna in Olive Oil Salt Added; 5 oz. Trader Joe’s Skipjack Tuna in Water With Sea Salt; and 5 oz. Trader Joe’s Yellowfin Tuna in Olive Oil Solid Light.
Under the terms of the Trader Joe’s settlement, the grocer has agreed to pay Class Members $29 per household with no receipts required. The actual payment could be lowered if claims surpass the total settlement fund.
The Trader Joe’s class action lawsuit claimed that despite being labeled as containing “5 oz.” of tuna, government testing proved that the majority of Trader Joe’s canned tuna products had less than three ounces of actual fish.
The testing performed by the U.S. National Oceanic and Atmospheric Administration (NOAA) found that sample cans of Trader Joe’s Tuna were between 9.9 and 24.8 percent under the nationally imposed minimum standard of fill.
According to the Trader Joe’s class action lawsuit, NOAA testing found that Albacore Tuna in Water Half Salt and Trader Joe’s Albacore Tuna in Water No Salt Added both contained only 2.43 ounces of tuna whereas the standard is no less than 3.23 ounces.
The Trader Joe’s Tuna class action lawsuit further claims that customers were misled by the “5 oz.” labels and subsequently overpaid for a mislabeled product.
The plaintiffs say the nationwide retailer is in breach of express and implied warranty, violated numerous California and New York state laws, and has been unjustly enriched by the label misrepresentations.
Trader Joe’s denies any wrongdoing and argues that its canned tuna products are correctly filled and labeled. However, the defendant has decided to settle the allegations against them in an effort to avoid further litigation.
Class Members have until July 1, 2020 to file a claim. Other important deadlines can be found on the settlement website.
Who’s Eligible
All U.S. consumers who bought one or more cans of Trader Joe’s Tuna between Jan. 5, 2012 and March 2, 2020. The following products are included:
- 5 oz. Trader Joe’s Albacore Tuna in Water Salt Added
- 5 oz. Trader Joe’s Albacore Tuna in Water Half Salt
- 5 oz. Trader Joe’s Albacore Tuna in Water No Salt Added
- 5 oz. Trader Joe’s Albacore Tuna in Olive Oil Salt Added
- 5 oz. Trader Joe’s Skipjack Tuna in Water With Sea Salt
- 5 oz. Trader Joe’s Yellowfin Tuna in Olive Oil Solid Light

Proof of Purchase
Not required. Class Members must file a claim form and indicate which Trader Joe’s Tuna products they bought under penalty of perjury.
