Subwayโ€™s tuna sandwiches and wraps have absolutely no tuna in them, according to a $5 million class action lawsuit accusing the sandwich chain of fraud among other things.ย 

The Californians who filed the Subway class action lawsuit say โ€œthey were tricked into buying food items that wholly lacked the ingredient they reasonably thought they were purchasing.โ€ย 

The lawsuit was filed after independent testing found that Subwayโ€™s tuna is a mixture of various concoctions that look similar to tuna, but in fact, is not tuna.ย 

The actual ingredients of the concoctions were not revealed, but the plaintiffsโ€™ lawyer hinted that it may not even be seafood that Subway is serving.

โ€œWe found that the ingredients were not tuna and not fish,โ€ the attorney told The Washington Post.ย 

Class Action Lawsuit: Subwayโ€™s Tuna Sandwiches Contain No Actual Tuna

The Californians are accusing Subway of breaking several laws by negligently and intentionally misrepresenting its tuna sandwich to customers.ย 

โ€œDefendants have no reasonable basis for labeling, advertising, marketing and packaging the Products as being or containing โ€˜tuna,โ€™โ€ the proposed class action lawsuit asserts. โ€œAs a result, consumers are consistently misled into purchasing the Products for the commonly known and/or advertised benefits and characteristics of tuna when in fact no such benefits could be had, given that the Products are in fact devoid of tuna.โ€

The plaintiffs are looking to represent a Class of other consumers in California who bought a tuna sandwich or wrap from Subway since 2017 thinking they were getting actual fish.ย 

Subway is standing by its tuna sandwich asserting that its tuna is not only fish, but wild-caught fish, according to The Washington Post.ย 

Subwayโ€™s Sandwiches Taken Apart in Legal Actions Challenging its Authenticity

This is far from the first legal action challenging Subwayโ€™s sandwiches. Just last year Irelandโ€™s Supreme Court ruled that Subwayโ€™s bread was not actually bread. Judges found that Subwayโ€™s โ€œbreadโ€ contained too much sugar to be legally called bread, according to NPR.ย 

A spokesperson for the sandwich chain brushed off the ruling saying in part, โ€œSubwayโ€™s bread is, of course, bread. We have been baking fresh bread in our restaurants for more than three decades and our guests return each day for sandwiches made on bread that smells as good as it tastes,โ€ according to NPR.ย 

Also in 2020, A Canadian judge authorized a class action lawsuit challenging Subwayโ€™s chicken sandwiches. This came after a 2017 CBC marketplace article that reported a DNA analysis revealed the chicken in Subwayโ€™s chicken sandwiches contained โ€œ50% of chicken DNA, the rest being made up of soy.โ€

The DNA analysis was reportedly performed by a researcher at a Trent University laboratory. Subway fired back with a defamation lawsuit against the CBC claiming its reporting was reckless and malicious. That part of the food fight ended with a judge ordering Subway to pay $500,000 in legal fees to CBC.ย 

As for the proposed Subwayโ€™s tuna sandwich class action lawsuit, the plaintiffโ€™s attorneys believe that if itโ€™s certified, it could include thousands of California Subway consumers.ย

    This is another shock! So, when the owners of Subway eat Tuna, do they expect it to be real tuna, or just fish??? I always wonder when people lie and deceive others, do they ever take into consideration how they would feel if the shoe were on the other foot?? Their tuna sandwich is the only sandwich I have eaten for the last 20 years. What are we eating, then???

    This should definitely move forward, and they should pay for what they have done. Disgraceful! Please add meโ€ฆthank you..
