Snapple All Natural Flavors Class Action Lawsuit Overview: 

  • Who: Kelly Williamson filed a class action lawsuit against Dyla LLC. 
  • Why: Williamson claims Dyla LLC misled consumers by selling Snapple brand diet peach tea powdered drink mix mislabeled as only containing natural flavors.
  • Where: The class action lawsuit was filed in New York federal court.

Dyla LLC misleads consumers by selling Snapple brand diet peach tea powdered drink mix falsely labeled as containing only natural flavors, a new class action lawsuit alleges. 

Plaintiff Kelly Williamson claims that, despite a label on the packaging declaring it is “Naturally Flavored With Other Natural Flavors,” the Snapple powdered drink mix contains DL-malic acid, which does not occur naturally. 

While malic acid is listed on the drink mix package’s ingredients list, laboratory analysis shows it is the DL-malic acid version, a synthetic chemical, according to the class action lawsuit. 

“Since there are natural and artificial types of malic acid, Defendant is required to tell consumers if it used the artificial version instead of only using the generic name,” the class action lawsuit states. 

DL-Malic Acid Not Naturally Occurring, Plaintiff Claims

Williamson claims Dyla used dl-malic acid instead of naturally occurring L-malic acid because the synthetic version is “lower priced” and/or more accurately “resembled natural peach flavor.” 

Further, consumers would not have been able to determine on their own if the malic acid was the natural or synthetic version, Williamson claims.

“Reasonable consumers must and do rely on a company to honestly identify and describe the components, attributes, and features of a product, relative to itself and other comparable products or alternatives,” the class action lawsuit states. 

Williamson claims Dyla was able to sell more of the product and at a higher price than it would have had consumers known the truth about it containing a non-natural ingredient. 

“The value of the Product that Plaintiff purchased was materially less than its value as represented by Defendant,” the lawsuit states. 

Williams claims Dyla is guilty of breach of contract and unjust enrichment and in violation of New York General Business Law, multiple state consumer fraud acts, and the Magnuson Moss Warranty Act, among other things. 

Williamson wants to represent an Illinois class and multistate subclass of consumers who purchased the Snapple brand diet peach tea powdered drink mix. 

Plaintiff is demanding a jury trial and requesting injunctive relief along with monetary, statutory and punitive damages for herself and all class members. 

A similar class action lawsuit was filed earlier this month alleging Kellogg’s misleads consumers’ about the strawberry content of its Pop Tart brand Whole Grain Frosted Strawberry Toaster Pastries.
