POM Wonderful 100% Pomegranate Juice is deceptively marketed as healthy and natural yet contains harmful “forever chemicals,” a new class action lawsuit alleges.
Plaintiff Bertha Hernandez filed the class action complaint against The Wonderful Company and POM Wonderful LLC Feb. 14 in a New York federal court, alleging violations of state and federal consumer law.
According to the lawsuit, Wonderful prominently labels the product as containing only the juice of “All Natural” California pomegranates when Hernandez says her testing revealed it contains per- and polyfluoroalkyl substances (PFAS), a category of synthetic chemicals.
“PFAS are a group of synthetic, man-made chemicals known to be harmful to both humans and the environment,” the POM class action states. “Because PFAS persist and accumulate over time, they are harmful even at very low levels.”
POM Wonderful 100% Pomegranate Juice drink deceives consumers, lawsuit alleges
The defendants market and sell the product as an “Antioxidant Superpower,” “100% Pomegranate Juice” and “All Natural,” the lawsuit states.
However, despite Wonderful’s “consistent and pervasive marketing” representations that their product is a healthy, all natural, 100% juice drink, it actually contains man-made chemicals with a toxic, persistent and bioaccumulative nature that are associated with numerous health concerns, the POM class action alleges.
“As a result of Defendants’ misconduct, Plaintiff and putative Class Members have suffered injury in fact, including economic damages,” the lawsuit claims.
Hernandez sued for violations of New York General Business Law, breach of express warranty, fraud, constructive fraud and unjust enrichment. She seeks certification of the class action, damages, fees, costs and a jury trial.
She seeks to represent anyone who bought the POM Wonderful 100% Pomegranate Juice drink, which is made and marketed by the defendant companies.
In other POM Wonderful news, in 2012, a judge with the Federal Trade Commission ruled that Wonderful used deceptive ads to imply the product could treat or prevent serious diseases and other medical conditions without the evidence to back it up.
