Danone North America manufactures, markets, labels, and sells International Delight brand coffee whitener products that are falsely identified as coffee creamer, a new class action lawsuit alleges.
Plaintiff Michele Jasper claims Danone’s International Delight brand white chocolate raspberry and hazelnut flavored “coffee creamer” products are misleadingly represented because they lack “cream or dairy ingredients beyond a de minimis amount of sodium caseinate.”
Jasper argues the International Delight “coffee creamer” products substitute cream and dairy ingredients with water and palm oil, in order to save on costs.
“The Product is not labeled in a way that distinguishes it from coffee creamers made from cream, through conspicuous statements such as ‘non-dairy’ or ‘a vegetable product – contains no milk or milk fat,’” states the International Delight class action.
Jasper wants to represent an Illinois class and multi-state consumer fraud class of individuals who have purchased an International Delight white chocolate raspberry or hazelnut flavored “coffee creamer” product.
International Delight ‘coffee creamer’ sold at premium price, says class action
The International Delight “coffee creamer” products are sold at a premium price due to their alleged misrepresentation, since consumers value cream over non-dairy coffee whiteners, the International Delight class action alleges.
Danone is accused of unjust enrichment, negligent misrepresentation, and fraud, and of violating the Magnuson Moss Warranty Act, various state consumer fraud acts, and the Illinois Consumer Fraud and Deceptive Business Practices Act.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of monetary, statutory, and/or punitive damages for herself and all class members.
A similar class action lawsuit was filed against Danone in June by a consumer arguing its International Delight brand French Vanilla Coffee Creamer was misrepresented as a coffee creamer.

I can read and know there’s no dairy. I’m allergic to dairy so I love it. Stop this ridiculous lawsuit and quit disrupting the pleasure I get out of my morning coffee.

I bought the French Vanilla. I recently learned that Carrageenan (an ingredient used in the International Delight Creamer may cause cancer. Disappointing!!!
I just bought ID French Vanilla coffee creamer and there are chunks! From the start, so I check the “sell by date” and it says 30 SEP 2023, but it’s only June 17, 2023! Wth is up with that?! Yeah ADD ME TOO!
