Chobani falsely advertises that its zero sugar yogurt contains “no sugar” despite it allegedly containing four grams of allulose, a naturally occurring sugar found in figs, raisins, wheat, maple syrup and molasses, a new class action lawsuit alleges. 

Plaintiffs Jason Franco, Abigail Franco, Misty M. Lacy and John D. Baker claim Chobani has sold millions of containers of zero sugar yogurt that actually contain “quite a lot of sugar” to “unsuspecting consumers.” 

The Francos, Lacy and Baker argue Chobani intentionally mislabels its Zero Sugar yogurt products to deceive consumers as part of an alleged scheme they assert is “just plain wrong.” 

“To peddle this contradiction in terms, Defendant deceived the public through misleading packaging statements and labels,” the Chobani class action states. 

The plaintiffs want to represent a nationwide class and individual classes of consumers from a total of 37 states who have purchased Chobani Zero Sugar yogurt. 

Chobani fails to put ‘sugar asterisk’ next to allulose on Zero Sugar yogurt ingredient list, class action says

Chobani, while listing allulose on the ingredients list for its zero sugar yogurt, failed to include an asterisk to signify that it would add a “trivial amount of sugar” to the product, the Chobani class action alleges. 

The Francos, Lacy and Baker argue Chobani further confuses consumers by placing a “sugar asterisk” next to other ingredients, including skim milk and vegetable juice concentrate, on the product’s list. 

“Because Chobani disclaims the presence of any real sugars or artificial sweeteners elsewhere on the label, reasonable consumers are deceived into believing that they are buying a product that is not sweetened with sugar,” the Chobani class action states. 

The Francos, Lacy and Baker claim Chobani is guilty of unjust enrichment, constructive trust for money had and received and state law violations. 

They demand a jury trial and request declaratory relief along with an award of actual, compensatory, punitive, statutory, treble, equitable and consequential damages for themselves and all class members. 

A consumer filed a separate class action lawsuit against Chobani last year, arguing the company falsely represents that its yogurt products are produced through an ethical supply chain.

      When my doctor told he I was prediabetic I decided to purchase the zero sugar Chobani yogurt to eat as a snack everyday. I am very upset because they where false advertising:(

    Not only is it terrible to be a diabetic and have to check your glucose 3 X a day. But when you go to the store and you purchase an item thinking there is no sugar in it when really there that makes me furious. My daughter checks everything to make sure there isn’t any sugar, added sugar, and no sugar alcohols. Only to find out it contained sugar!!! Outrageous!!!

    I eat Chobani yogurt all the time when I’m at work. I usually just snack on it with some granola during my shift. Even when I was pregnant with My first and second daughter that was my favorite yogurt. I love to eat before going to bed but now yogurt. the harmful chemicals in and now I don’t think I’ll ever eat it again.

    Add me to the claim! I ate them a lot while in the military, pregnant & now. WOW can’t even eat healthy or stay healthy smh because healthy food be harming you too
