
BrucePac class action lawsuit overview:

A new class action lawsuit alleges that BrucePac manufactured and sold ready-to-eat precooked meat and poultry products that were contaminated with listeria monocytogene bacteria.
Plaintiff Britton Bryant’s class action lawsuit claims BrucePac’s ready-to-eat food products were unfit for consumption due to the listeria contamination, which led the company to recall nearly 12 million pounds of ready-to-eat meat and poultry products earlier this month.
“Plaintiff has been caused to purchase a defective product that is worthless, or worth less than the price paid because the Product was contaminated with Listeria monocytogenes,” the BrucePac class action says.
Bryant wants to represent a nationwide class, as well as South Carolina and Pennsylvania subclasses, of consumers who purchased BrucePac’s recalled ready-to-eat meat or poultry products within the applicable statute of limitations period.
Consumer became ill after eating chicken product later recalled by BrucePac, class action claims
Bryant claims they became sick with diarrhea and gastrointestinal distress after consuming a Marketside Caesar Salad with chicken in August that was later included in the BrucePac recall.
“At the time, Plaintiff did not seek medical attention because he did not know that Defendant’s ready-to-eat chicken was the source of the bacteria contamination,” the BrucePac class action says.
Bryant claims BrucePac is guilty of unjust enrichment, breach of express warranties, breach of implied warranties, strict products liability and negligence.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, statutory, and punitive damages for himself and all class members.
The BrucePac recall involved ready-to-eat meat and poultry products produced between May 31, 2024, and Oct. 8, 2024, and distributed to restaurants, schools and other institutions nationwide.

My wife became very sick after eating the chicken salad BrucePac makes. It was sold at target and we have made complaint with the USDA and FSIS officially. We have frozen the actual package -as the USDA has requested for us to do. They need to have their asses handed to them for making so many sick, many have no idea the sickness is coming from them. But, my wife was so sick and Targets quick to get off the phone and stated they have done everything correctly made me very suspicious. Looked into it and found out a lot more then I bargained for.
I purchased premade amazon salads in september 16th and 25th that had the listeria bacteria. I became so sick I blacked out while going to the bathroom, my blood pressure was 80/40, which is in stroke level so I could have had a stroke and had to go to the hospital. Then I just received the recall notice from Amazon yesterday on November 13th. They did refund me, but that was the only compensation they offered.
