California consumers have reached a class action settlement resolving allegations that the Wise Company misrepresented how long its emergency food kits would last.

If you purchased long-term food products from the Wise Company in California between Feb. 15, 2013 and Dec. 31, 2017, you could get up to $1,400 per product from this class action settlement. More than 20 products are included in the class action settlement.

Lead plaintiffs accused the Wise Company of deceptively advertising its food kits. In particular, the company touted various food kits as sufficient to sustain a particular number of people, for a length of time as a part of disaster preparedness.

However, the kits, according to the plaintiffs, would not sustain a person for the amount of time advertised. The Wise long-term food class action lawsuit contended that the calories provided by the kits would lead to adverse health effects and starvation in the event a person needed to rely upon them for survival.

The Wise Company class action lawsuit alleges that consumers spent hundreds of dollars on Wise food kits at major retailers, including Walmart, Costco, and Sam’s Club.

According to the Wise long-term food class action lawsuit, the company violated California consumer protection laws.

Wise agreed to pay Class Members between $15 and $1,400 per product as a part of a settlement agreement to end the class action lawsuit.

In addition, the company has agreed to change its marketing of the food kits. Specifically, Wise will no longer indicate that its food kits will provide a certain number of meals for a certain number of days.

Class Members who did not purchase their food kit directly from Wise or who cannot provide a claim ID number, must submit proof of purchase, including a receipt or picture of the UPC code. Class Members must also provide the product and store name where the Wise long-term food kit was purchased.

Consumers who file a claim will receive 20 percent of the average purchase price of each product based on the year they purchased it.

Class Members have until May 28, 2019 to exclude themselves or opt out of the Wise long-term food class action settlement.

Class Members include those who purchased any of the following products from Wise Company in California between Feb. 15, 2013 and Dec. 31, 2017;

  • 240 Serving Long-Term Food Supply Package;
  • 3-Month Emergency Food Supply Box;
  • 360 Serving Long-Term Food Supply Package;
  • 6-Month Emergency Food Supply Box;
  • 720 Serving Long-Term Food Supply Package;
  • 1080 Serving Long-Term Food Supply Package;
  • 12-Month Emergency Food Supply Box;
  • 1440 Serving Long-Term Food Supply Package;
  • 2160 Serving Long-Term Food Supply Package;
  • 2880 Serving Long-Term Food Supply Package;
  • 4320 Serving Long-Term Food Supply Package;
  • Ultimate Emergency Prepper Pack, 1 Month for 2 adults;
  • Ultimate Emergency Prepper Pack, 1 Month for 4 adults;
  • Ultimate Emergency Prepper Pack, 3 Months for 1 adult;
  • Ultimate Emergency Prepper Pack, 3 Months for 2 adults.
Potential Award

$15 to $1,400 per product, depending on product(s) purchased.
