Patrons of La Carreta restaurant in Summerville, South Carolina, may be eligible for payments of thousands of dollars as part of a $1 million class action settlement.

The Class consists of all South Carolina residents who consumed food at La Carreta at 1580 Old Trolley Road, A, Summerville, South Carolina, 29485, during November and December 2018, and who suffered gastrointestinal illnesses or other injuries arising from the food they consumed.

The plaintiffs in a class action lawsuit claimed about 290 people became ill with norovirus after eating at the La Carreta restaurant in Summerville in November and December 2018, according to court documents and reporting by NBC affiliate News2. 

Symptoms of norovirus infection typically begin 12 to 48 hours after exposure and can include vomiting, stomach pain, and diarrhea, according to the Mayo Clinic. 

The symptoms usually last one to three days, and most people who contract the virus don’t require medical treatment. But others can become severely dehydrated and require medical treatment.

La Carreta’s insurer will create a settlement fund of $712,000, which is subject to increase based on the number of claims submitted by Class Members who can show evidence of medical treatment; the maximum amount La Carreta will be obligated to pay is $1 million.

Each Class Member who is able to provide evidence of medical treatment related to dining at La Carreta along with their claim will be eligible to receive either three times the amount of the medical bills submitted or $5,000, whichever is greater.

Class Members who submit claims but don’t provide proof of medical treatment must provide proof of purchase and a signed affidavit affirming their contraction of gastrointestinal illness, or a complaint submitted to the South Carolina Department of Health and Environmental Control with their contact information and a signed affidavit regarding gastrointestinal issues. These Class Members will be eligible for up to $1,000.

A final hearing in the La Carreta food poisoning class action settlement is scheduled for July 16, 2021.

Anyone wishing to opt out of or object to the La Carreta settlement 

Claim forms must be printed and returned to the claims administrator by June 1, 2021.

Who’s Eligible

All South Carolina residents who consumed food at La Carreta at 1580 Old Trolley Road, A, Summerville, South Carolina, 29485, during November and December 2018, and who suffered gastrointestinal illnesses or other injuries arising from the food they consumed.
