  • Lenovo Inc. seeks dismissal of a class action lawsuit accusing the global tech company of selling an allegedly defective desktop computer model.
  • Lenovo claims the complaint is “the latest vexatious litigation” to be filed by Spencer Sheehan of Sheehan & Associates P.C., which they argue has filed more than 400 putative class actions since 2020.
  • The judge ordered the consumer behind the class action lawsuit to either file an amended complaint within 21 days time or respond to Lenovo’s motion to dismiss. 
  • The consumer claims Lenovo misled its customers about the reliability of its Legion T5 desktop model, arguing it regularly freezes despite being marketed for its supposed high performance.

Lenovo manufactured and sold Lenovo Legion T5 28IMB05 desktop computers containing hardware and software defects that cause the device to frequently freeze and/or crash, a new class action lawsuit alleges. 

Plaintiff Josh Dinwiddie claims Lenovo misleads consumers who expect the Lenovo desktop computer to “function reliably for games, graphic design and other everyday use without freezing or crashing.” 

Dinwiddie argues the affected Lenovo desktop computers contain NVIDIA audio and graphics drivers believed to be incompatible with the desktop’s other drivers, software and components. 

“While temporary options have been proposed including re-installing the relevant drivers, a permanent solution has not or took significant amounts of time to materialize,” the Lenovo class action states. 

Lenovo class action claims company failed  to categorize alleged issue as defect

The alleged defect is “especially frustrating” for affected users since Lenovo has failed to categorize the issue as a defect, preventing them from being able to get warranty coverage to fix it, the lawsuit states.

“Consumers expect a computer represented – directly or indirectly – as capable of functioning reliably, not freezing or crashing, and running smoothly during operation, to act as promised,” the Lenovo class action states.

Dinwiddie wants to represent a Michigan class and multistate consumer fraud class of individuals who have purchased a Lenovo Legion T5 28IMB05 desktop computer during the statute of limitations. 

He accuses Lenovo of unjust enrichment, negligent misrepresentation and fraud and of violating multiple state consumer fraud acts, including the Magnuson Moss Warranty Act and the Michigan Consumer Protection Act

Dinwiddie demands a jury trial and requests declaratory and injunctive relief along with an award of monetary, statutory and/or punitive damages for himself and all class members. 

A consumer filed a separate class action lawsuit against Lenovo in June, arguing the company uses fake valuations for its desktop and laptop computers to offer discounts on its website that appear greater than they actually are.

    2025, is it too late to join this lawsuit? I’ve had my lenovo legion 5i I got from costo, at first they kept helping me and it would temporarily help, always lasted a few weeks before it started crashing again, I have tried every single fix, eventually it starts crashing again, I don’t have a lot of money, I got this computer through a family member’s costco membership and use my TV as a screen, I literally can’t afford a better computer, I didn’t expect the best computer but the fact that I got one like this really hurts, I don’t have a job, I saved up christmas and birthday moneys for years to get this computer on sale, people said it was great, I waited too long which was my fault before I started complaining about the crashes, they haven’t gotten worse but they haven’t gone away, they are so inconsistent, when I found out it was a known problem it hit me in the gut, before my warranty expired I sought help from lenovo, they rolled my drivers back and left it at that, said I would be fine, it worked for about two months then crashed again, since then I’ve tried 3 or 4 different fixes but none ever worked forever, it is really sad that lenovo did this and refuses to own up to it. I still have the computer in its original state, it crashes pretty much daily but sometimes I can go up to 2 days without a crash and other times I can get 2-3 crashes in a single day, I noticed the crashes can be very random and sporadic, sometimes it can happen when gaming, sometimes the computer will be starting up and crash, sometimes while watching youtube, sometimes while writing, but it always leads to some kind of blue watchdog violation screen.

    I have a Legion T5-28IMB05 desktop that has froze up and crashed regularly since i purchased it in 2021. I also have a Legion S7 16ARHA7 laptop that has also begun freezing up and crashing. They were purchased for school and they have for sure made my school experience 10 times more frustrating!

    My Lenovo legion 5 desktop computer, with warranty starting in march 2021 , will freeze within 15 minutes, then restart, or stay off, this Lenovo legion 5 desktop has been doing this from the first day of use to the present day today Dec. 20/ 2023

    My Legion desktop fails daily, often tied to Nvidia drivers, it will restart with no sound, it’s driving me nuts and I cannot buy a new CPU at this time.

    I also have a idea pad laptop it’s don’t that since my daughter bought during Christmas a few years ago it freezes up all time
