Plantronics BackBeat FIT wireless headphone owners can get up to $100 from a class action settlement that resolves claims that the headphones were falsely advertised as being able to provide eight hours of listening after one charge, as well as being water and sweat-proof.
Class Members include those who purchased certain versions of the BackBeat FIT wireless headphones manufactured by Plantronics between April 1, 2014 and Oct. 31, 2019. The versions included are the Genesis and 16M.
The Plantronics BackBeat FIT wireless headphones class action lawsuit alleged that the sport headphones did not live up to their advertising claims.
According to the complaint, the headphones regularly fail to hold a charge due to a battery defect. Additionally, exposure to water only makes the problem worse, alleged the plaintiffs.
The Plantronics BackBeat FIT wireless headphones class action lawsuit pointed to numerous consumer complaints about the alleged battery defect. The complaints noted that the headphones both ran out of battery in a short amount of time and also failed to hold a charge.
Plantronics admits no wrong doing, but agreed to settle the allegations. Under the terms of the settlement, Class Members can benefit in several ways depending on when they purchased the headphones and whether or not they had complained about issues with the headphones.
Class Members who purchased headphones covered by the class action settlement on or after Jan. 1, 2018 can claim an extended limited warranty. Those who purchased the headphones between April 1, 2014 and October 31, 2019 can claim a $25 payment with proof of purchase. Those who purchased headphones between April 1, 2014 and October 31, 2019 and also made a complaint about the product can make a $50 claim (limit of two headphones per claimant).
To make a valid claim, Class Members must submit a Claim Form. In order for the claim to be valid, you should provide proof of purchase. However, you should still submit your claim even if you do not have proof of purchase (i.e., receipt) because class counsel may have already obtained proof of purchase information from the third-party retailers who sold the headphones and this information has been provided to the settlement administrator.
The deadline to object to or opt out of the Plantronics BackBeat FIT wireless headphones class action settlement is Nov. 22, 2019.
Class Members include those “who purchased at retail the BackBeat FIT wireless headphones, version Genesis or 16M, manufactured by Plantronics during the period of time from April 1, 2014 through October 31, 2019.”
Up to $100.
Class Members have several benefit options under the Plantronics headphones class action settlement:
- Extended warranty
- $25 cash – for those who received a replacement product
- $25 cash – for those who haven’t received replacement headphones (limit of two claims per Class Member)
- $50 cash – with proof of purchase (limit of two claims per Class Member)
Proof of Purchase
Proof of purchase required for all claims. Those who are making a claim for a $50 payment must provide proof of a complaint, for example, a negative comment specifying the alleged battery defect on Plantronics.com or Amazon.com.
NOTE: If you do not qualify for this settlement do NOT file a claim.
