Consumers who purchased a cell phone since Feb. 11, 2011, may be affected by a Qualcomm antitrust class action lawsuit pending in federal court.

A settlement has not been reached and no money is available at this time. However, this litigation is being dubbed “quite likely the biggest class action in history,” and may affect the rights of more than 250 million cell phone owners.

Numerous Qualcomm class action lawsuits claimed that consumers paid higher prices than they should have for cell phones based on the inflated cost of modem chipsets.

The lawsuits alleging Qualcomm engaged in anticompetitive behavior were consolidated into multidistrict litigation in April 2017.

U.S. District Judge Lucy H. Koh granted Class certification of the Qualcomm antitrust litigation in September 2018. The Class covers any U.S. consumer or entity that bought a cell phone with a Qualcomm modem chipset inside it since February 2011.

However, Qualcomm was quick to ask the court to revisit the decision to certify a Class of that size by stating that it’s “simply too large and unwieldy to manage.”

“Without holding a hearing, the district court in this action certified a class estimated to be the size of the entire adult population of the United States—around 250 million people—and one that encompasses approximately 1.2 billion transactions,” Qualcomm stated in its petition to the Ninth Circuit.

Experts estimate that with a Class size of 250 million members, financial damages could range between $4.84 billion and $5.54 billion.

Class Members do not have to do anything at this time to remain included in the Qualcomm antitrust litigation. Those consumers who would like to be excluded from this multidistrict litigation and retain the right to sue Qualcomm over similar allegations must do so no later than March 22, 2019.

However, by excluding yourself from this Qualcomm antitrust class action lawsuit, you will not receive any money if a settlement or judgment is eventually reached.

UPDATE: On Jan. 23, 2019, Qualcomm was granted an immediate appeal of a massive certified Class of cellphone owners involved in a class action lawsuit alleging the company overpriced chips ubiquitous in mobile devices. Qualcomm contends that the newly certified Class of about 250 million consumers is “simply too large and unwieldy to manage” in a petition to appeal the decision brought to the Ninth Circuit two-judge panel.

Who’s Eligible

Class Members include all U.S. residents who bought UMTS, CDMA (including CDMAone and cdma2000) and/or LTE cell phones for personal use since Feb. 11, 2011.

If you were provided with one of these phones with CDMA and LTE technologies from a wireless operator such as Verizon, AT&T, T-Mobile, or Sprint, you are considered a Class Member.

Class phones were manufactured and sold by companies such as Apple, Samsung, LG, Motorola, and ZTE.

No monetary award is available yet.

The amount each Class Member will receive from the Qualcomm antitrust class action lawsuit is unknown at this time. More details will be provided if/when a settlement is reached.

    I had an LG Android phone bursts into flames! In my hand! The battery was glowing red hot, then it bursted spewing multicolored flames in every direction. It was burning white hot in the carpet all over in front of me, smoke galore and it smelled awful as I gagged for air. I then threw my thick Carhartt winter coat over the flaming battery and it incinerated a hole threw the thick coat in about 2 seconds. I continued to smother the fire and finally it went out….but the smoke was thick and it burned a huge hole in the floor in many spots. I want to file a lawsuit. Thank you
