Juul Labs has deliberately targeted Native American tribes with its Juul e-cigarette products, according to a report made to Congress in the first week of February.
Juul has, of course, been the subject of much controversy in recent years, as its products have been linked with serious lung health complications, and as the U.S. Food and Drug Administration (FDA) investigates the company’s marketing strategies, especially toward children and young people.
This recent report from the House Subcommittee on Economic and Consumer Policy indicates that Juul made persistent and dangerous efforts to market its Juul e-cigarette products to at least eight Native American tribes according to Law360.
Congress had already heard testimony that Juul was making deceptive claims to the Cheyenne River Sioux, claiming that their e-cigarette products were healthy. Notably, Juul products do not have FDA approval, and in fact have been linked with a number of serious complications.
According to this new report, “JUUL now admits that its targeting of Native American tribes was more widespread.”
Indeed, the report said, Juul admitted that from Dec. 2018 through Feb. 2019, Juul pitched its products to the leaders of at least eight Native American tribes, including the Chickasaw Nation in Oklahoma and the Lummi Nation in Washington State.
The company pitched its Juul e-cigarette products like Juul pods as methods of quitting smoking, and offered to sell $50 starter kits for $5 each to the tribe, which could then distribute these for free to those who signed up for a program to help them switch off of regular cigarettes. Juul told tribe leaders that the devices helped smokers quit cigarettes, and were less harmful than traditional tobacco products, the report said.
“These claims as well as JUUL’s actions to hand out free product are all clear violations of the Family Smoking Prevention and Tobacco Control Act,” said the report.
The report also detailed Juul’s plans moving forward regarding its flavored products. The company said that it may introduce new flavors in the future.
“JUUL confirmed that it may seek to introduce ‘non-tobacco flavors,’ leaving the door open for introducing new flavors or re-introducing the flavors like mango and mint that are already proven to be popular with children,” according to the report.
The use of Juul e-cigarette products with children and young people is a serious concern. In Sept. 2018, then-FDA Commissioner Scott Gottlieb said that the use of e-cigarettes amongst teens and young people is “nothing short of an epidemic proportion of growth.”
Indeed, according to the FDA, more than 5 million middle and high school students were current users of e-cigarettes in 2019, and about 1 million of these students used these products every day.
