RiseWell children’s toothpaste class action lawsuit overview:

  • Who: Plaintiffs Alana Watkins and Jo Ann Accardi filed a class action lawsuit against RiseWell LLC d/b/a RiseWell.
  • Why: RiseWell children’s toothpaste, which is advertised as “natural” and chemical free, allegedly contain PFAS forever chemicals that have been linked to potential health issues.
  • Where: The RiseWell toothpaste PFAS lawsuit was filed in California federal court.

RiseWell children’s toothpaste is falsely advertised as being free of chemicals even though they contain harmful “forever chemicals” that may pose health risks, according to a recent class action lawsuit.

Plaintiffs Alana Watkins and Jo Ann Accardi say they purchased RiseWell children’s toothpaste because it was advertised as being safe to swallow and believed the product was toxin-free.

Prior to purchasing the toothpaste, the plaintiffs say they reviewed the product’s marketing and advertising, trusting the company’s claims the toothpaste is “safe to swallow” and “naturally effective.” 

However, they have learned RiseWell children’s toothpaste contains perfluoroalkyl and polyfluoroalkyl substances, or “PFAS.” 

PFAS are a group of synthetic chemicals that break down extremely slowly over time and tend to build up in the environment and within bodies.

The toothpaste PFAS class action lawsuit alleges these forever chemicals have been linked to health issues such as increased cholesterol, decreased fertility and increased risk of certain cancers.

Plaintiffs say they paid a premium for RiseWell children’s toothpaste

Laboratory testing reportedly found RiseWell children’s toothpaste contained more than 188 parts per billion of PFAS.

Watkins and Accardi claim no reasonable consumer would expect a product marketed as a natural, toxic-free toothpaste to contain PFAS. In fact, they say RiseWell charges as much as $12 per tube of the purportedly natural product while the average toothpaste costs about $4.

They say they paid more for the product than they would have paid had they known about the truth about the toothpaste PFAS.

The plaintiffs  filed the toothpaste PFAS lawsuit on behalf of a proposed class of consumers who purchased RiseWell children’s toothpaste since June 11, 2020. They also seek to represent a California and New York subclass.

The toothpaste PFAS class action lawsuit asserts claims for violation of California’s Consumers Legal Remedies Act, Unfair Competition Law, False Advertising Law, New York’s General Business Law, fraud, fraudulent concealment or omission, breach of express warranty, negligent misrepresentation and unjust enrichment.

The maker of Hello toothpaste is facing a class action lawsuit alleging the product is falsely advertised as containing no artificial sweeteners even though they contain xylitol and sorbitol.
