A near $30 million settlement has been reached to resolve claims that water treatment chemicals were artificially fixed at a high price.
The settlement will benefit individuals from certain states who indirectly purchased liquid aluminum sulfate supplied by the defendants between Jan. 1, 1997 and Feb. 28, 2011.
States and territories included in the water treatment class action settlement are: Alabama, Arkansas, Arizona, California, Colorado, District of Columbia, Florida, Hawaii, Illinois, Iowa, Kansas, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Oregon, Puerto Rico, Rhode Island, South Carolina, South Dakota, Tennessee, Utah, Vermont, West Virginia, and Wisconsin.
Aluminum sulfate is a chemical used by many cities to treat drinking water. It may also be used by manufacturers in the paper making process.
In 2016, 19 class action lawsuits were filed against manufacturing companies accusing them of artificially raising the price of the chemical. These class action lawsuits were eventually consolidated.
According to the class action lawsuits, the companies used false bids to increase the price as part of a larger water treatment price-fixing conspiracy.
The water treatment class action lawsuit included claims against General Chemical, GenTek, Chemtrade, C&S Chemicals, USALCO, Kemira Chemicals, Southern Ionics, GEO Specialty Chemicals, American Securities LLC, and several company executives. These defendants have not admitted any wrongdoing by settling the case against them, but have agreed to pay $29.25 million.
Payment under the settlement will depend on both the number of claims filed and the dollar amount of the indirect purchase for each Class Member. Based on these factors, consumers will receive a proportional payment of the near $30 million settlement fund.
In order to benefit from the settlement, Class Members need to submit a valid claim online or through the mail by Feb. 15, 2020. The deadline for exclusion and objection is Oct. 7, 2019. The settlement’s final approval hearing is scheduled for Nov. 7, 2019.
Who’s Eligible
Individuals from certain states and territories who indirectly purchased liquid aluminum sulfate supplied by the defendants between Jan. 1, 1997 and Feb. 28, 2011. Potential Award
Varies depending on the total number of claims filed and the dollar amount of each Class Member’s purchases.
