Neurobrands LLC, maker of NeuroSONIC and other Neuro drinks, has agreed to a settlement over the presence of DL-malic acid in the beverages.
The Class includes California residents who purchased the following Neurobrands products for household or personal use, not for resale, between Jan. 1, 2012, and Oct. 15, 2020:
- NeuroSONIC Superfruit Infusion
- NeuroSONIC Orange Passion
- NeuroBLISS White Raspberry
- NeuroBLISS Citrus Berry
- NeuroBLISS Tropical Lychee
- NeuroPROTEIN Watermelon Mint
- NeuroPROTEIN Cherry Vanilla
- NeuroDAILY Tangerine Citrus
- NeuroGASM Passion Fruit
A class action lawsuit had alleged the labels on the Neuro drinks falsely claimed to contain “natural flavors” and “no artificial colors or flavors” when the beverages actually contain DL-malic acid, which the plaintiffs argue is a flavoring.
Neurobrands makes a variety of beverages and powder packets, each of which contains ingredients that are meant to provide certain benefits, such as help sleep, an immune system boost, and stress reduction. The products are sold at more than 70,000 locations throught the United States.
The company denies all allegations of wrongdoing, and the Court has not ruled in favor of either party in this case.
Under the terms of the settlement agreement, Neurobrands has agreed to make an effort to reformulate the covered products without using DL-Malic acid.
In the event a reformulated product is not feasible scientifically or commercially, Neurobrands has agreed to change the product labels and advertising by altering the ingredient list, replacing the phrase “no artificial colors or flavors” with “no artificial colors” on the product labels, and making other modifications.
All such changes will be permanent unless the DL-malic acid is removed from the products.
A final approval hearing in the Neurobrands DL-malic acid class action settlement is scheduled for Oct. 8, 2021.
The deadline to object to the settlement is Sept. 8, 2021.
Because the relief provided under the settlement is injunctive only, no Class Member may opt out, and no claim form is required.

California residents who purchased the following Neurobrands products for household or personal use, not for resale, between Jan. 1, 2012, and Oct. 15, 2020:
