RevitaLash serums class action overview:

The maker of the popular beauty serums RevitaLash and RevitaBrow has been sued by a customer who alleges the products contain a potentially dangerous ingredient that consumers aren’t informed about.

Plaintiff Rebecca Rush filed the class action complaint against Athena Cosmetics Inc. on Oct. 4 in a California federal court, alleging violations of state and federal consumer laws. 

Rush alleges that Athena misleadingly markets RevitaLash and RevitaBrow —  both hair growth products — as safe, natural cosmetics while concealing potential health risks associated with a key ingredient. She claims that after purchasing and using Athena’s serums, she and other consumers suffered adverse effects, including eye pain and inflammation.

The RevitaLash class action alleges that Athena’s serums contain the ingredient dechloro dihydroxy difluoro ethylcloprostenolamide (DDDE), a prostaglandin analog (PGA). DDDE belongs to a class of compounds that promote hair growth, much like the active ingredient in Latisse, an FDA-approved eyelash growth drug, the lawsuit says. 

However, products with PGAs can carry serious risks, including eye irritation, discoloration, and more severe conditions like blepharitis and chronic dry eye, the class action says.

Despite these risks, Athena’s serums are sold over-the-counter, without the FDA approval that Latisse requires, Rush alleges.

The FDA has issued warnings about the dangers of PGAs in over-the-counter lash and brow products, emphasizing that they should only be used under a physician’s supervision. But according to the lawsuit, Athena has ignored these warnings and continues to sell its serums without proper risk disclosure. The RevitaLash class action includes reviews and warnings from customers who report itching and eye issues. 

“Within minutes my eyes were extremely red, and also very itchy, the itch worsened through the day,” one customer reported.

Rush’s complaint alleges that Athena has been promoting its products as natural and safe, with no mention of the potential side effects of DDDE. 

Athena previously faced a legal setback when Allergan Inc. — the maker of Latisse — successfully obtained an injunction limiting Athena’s sale of PGA-containing products in California in 2014, the lawsuit states. Despite this, Athena resumed sales nationwide recently after the dissolution of the injunction.

Rush is looking to represent anyone in the United States who paid for the Athena serums. She accuses the company of violating consumer protection laws and of breaching warranties, and is seeking certification of the class action, damages, fees, costs and an injunction. 

Earlier this year, Elixir Cosmetics OPCO LLC agreed to a $2.3 million settlement to resolve a class action lawsuit claiming the company failed to disclose potential risks and side effects associated with an ingredient in certain Babe Lash and Babe Brow products.
