Consumers who purchased contact lens products from a variety of manufacturers may be able to benefit from a $13 million settlement.
The settlement will benefit consumers who purchased contact lenses from Alcon Vision LLC, Johnson & Johnson Vision Care Inc., ABB Concise Optical Group LLC, Bausch & Lomb Inc., or CooperVision Inc. since June 1, 2013 if the lenses were subject to a “unilateral pricing policy.”
On the contact lens settlement website, consumers also have the chance to exclude themselves from a recently certified Class of consumers bringing claims against the remaining defendants. More information about these Classes is available in the “Who’s Eligible” section below.
The contact lens class action lawsuit claims that several manufacturers used “unilateral pricing policies” to institute minimum retail prices for products. These policies allegedly limited competition from discount and online stores who also sold disposable contact lenses.
According to the contact lens class action, the unilateral pricing policies violated federal and state antitrust laws such as the Sherman Act.
Plaintiffs submitted a motion for preliminary settlement approval with CooperVision in February 2018. The $3 million settlement was granted preliminary approval in July 2018. Consumers may also be able to benefit from a $10 million settlement with Bausch & Lomb that was reached in August 2019.
Class Members will reportedly be able to collect an equal share of the net settlement fund based on the purchases made. No estimates are currently available for settlement payments as they will depend on a variety of factors such as the number of claims filed and the amount deducted in expenses.
Class Members who wish to receive benefits from the settlement need to file a claim form by Jan. 31, 2020. The deadline for exclusion and objection is also Jan. 31, 2020. The final approval hearing for the settlement is scheduled for Feb. 25, 2020.
The deadline to file a claim, object to, or opt out of the ABB settlement is March 10, 2021.
Who’s Eligible
Settlement Class Members include consumers who purchased contact lenses from Alcon Vision LLC, Johnson & Johnson Vision Care Inc., ABB Concise Optical Group LLC, Bausch & Lomb Inc., or CVI since June 1, 2013 if the lenses were subject to a “unilateral pricing policy.”
The other recently certified Classes include consumers who purchased contact lenses manufactured by Alcon Vision LLC, Johnson & Johnson Vision Care Inc., or ABB Concise Optical Group LLC between June 1, 2013 and Dec. 4, 2018 if the lenses were subject to a “unilateral pricing policy.”

Potential Award
Each Class Member will receive a pro rata portion of the net settlement funds. Payment amounts will depend on Class Member purchase amounts, the number of claims filed, and the amount deducted for costs and expenses.
