A class action lawsuit alleging Cel MD cosmetics were falsely advertised has been settled after the manufacturer, Amplify, agreed to a $753,285 payout.

Consumers who purchased covered Cel MD products between March 20, 2016, and Feb. 1, 2021, may be entitled to a class action rebate worth up to $10 under the terms of the settlement.

Lead plaintiff Diane Hightree accused Amplify of misleadingly marketing its Cel MD lines of hair and skin care products. The plaintiff alleged the hair products were advertised as a solution to hair loss. The Cel MD skin care line claimed to fight aging by tightening and rejuvenating skin, as well as aiding in healthy nail growth.

“These claims are false, misleading and deceptive,” the complaint alleged, noting the American Academy of Dermatology Association found that topical products, such as those in the Cel MD line, cannot prevent hair loss or re-grow hair.

Further, “Defendant’s promises to change the texture and ‘age’ of the skin and nails through plant stem cells and collagen, among other things, in their skincare Products is patently falsely and rejected by the scientific and medical communities,” the class action lawsuit contended.

Despite scientific evidence that topical products cannot regrow or strengthen hair or improve skin, the makers of Cel MD cosmetics allegedly duped consumers using false advertising.

According to the complaint, the company touted ingredients such as “Asparagus Stem Cells,” “Biotin,” “Ginseng” and other plant extracts as a solution to hair loss. The company also allegedly claimed its skin care products would boost cell activity to reduce wrinkles, tighten skin and improve nails.

The plaintiff alleged she and other consumers purchased Cel MD cosmetics in the hopes of improving their aging skin and hair; however, they would not have made the purchases had they known the products did not live up to their advertised claims.

While Amplify refused to admit any wrongdoing, it agreed to pay more than $750,000 to end the class action lawsuit. The settlement fund will be used to pay Class Member claims, plaintiff awards and attorney and administration fees.

Class Members can claim a $5 class action rebate for each Cel MD product they purchased. Up to two items, for a total of $10, can be claimed by Class Members without proof of purchase.

In addition to the class action rebate, Amplify has agreed to modify its advertising of Cel MD cosmetics to remove misleading claims about the product.

Class Members who wish to object to or opt out of the settlement must do so by Feb. 1, 2021. The final approval hearing is scheduled for March 2, 2021.

To make a claim, Class Members must submit a claim form either online or by mail by Feb. 1, 2021. Online claim forms require an ID number. Class Members must also either provide proof of purchase or provide information about the Cel MD products they purchased, including the date and location of the purchase and the quantity they bought.

$5 per product.

  • Class Members without proof of purchase can claim up to two products, for a total of $10.

    I used CellMD for the past 2/3 yrs. my hair grew fast and got thicker and longer. It was beautiful! BUT now, after stopping the use of this product, my hair is now a 3rd of the thickness it was. Hair loss is at a great loss. Add me to the law suit

    I am much too late discovering this lawsuit. I bought the shampoo & conditioner 3-4 times during 2019-2020, for a cost of over $175, plus the cel md eye serum, $60.
    With the pandemic, people are opting to purchase on-line rather than visit retailers. How can we be protected from these false claim of products that are supposed to help us. And who pays $30 for a bottle of shampoo? Me!
