Linda Evangelista CoolSculpting Lawsuit Overview:

Supermodel Linda Evangelista has filed a $50 million lawsuit against ZELTIQ Aesthetics alleging that its CoolSculpting System “permanently injured and disfigured” her, for which she claims ZELTIQ is liable for due to its negligence, fraudulent misrepresentation, and fraudulent concealment.

As a result of the CoolSculpting side effects and following corrective surgeries, Evangelista has suffered a complete loss of income, ongoing pain, social anxiety, and agoraphobia due to the aftermath, according to her complaint. 

In addition to $5 million in compensatory damages, the lawsuit demands payment of punitive and/or exemplary damages for the “wanton, willful, fraudulent, reckless acts of ZELTIQ,” attorneys’ fees, proceedings costs. 

Linda Evangelista CoolSculpting Side Effects

Relying on ZELTIQ’s presentation of CoolSculpting as “safe and effective” and “non-invasive,” Evangelista received seven CoolSculpting treatments between August 2015 and February 2016 for the intended purpose of breaking down fat cells in the body. 

In June 2016, Evangelista was diagnosed with paradoxical adipose hyperplasia (PAH), a complication of CoolSculpting that results in overgrowth of fatty tissues, after developing “hard, bulging, painful masses” under the treated skin.

After reporting her reactions to ZELTIQ, Evangelista underwent two corrective liposuction surgeries performed by a doctor chosen by ZELTIQ, both of which were unsuccessful and left immense scarring, according to the complaint. ZELTIQ allegedly offered to pay for the first corrective surgery, but 24 hours before the procedure, required Evangelista to sign a Confidentiality Agreement and Release agreement. ZELTIQ has not yet reimbursed the cost. 

ZELTIQ Knew About CoolSculpting Dangers Since 2013

The lawsuit argues that had ZELTIQ properly disclosed and adequately warned consumers, Evangelista and other consumers would not have undergone CoolSculpting treatment. Instead, ZELTIQ willfully misled consumers to get them to purchase CoolSculpting treatments at a premium price and further the company’s bottom line.

ZELTIQ was aware of possible occurrence of PAH and other adverse effects as early as March 2013 when it discussed these potential liabilities in an update to investors, according to court documents. 

ZELTIQ did not warn consumers about these risks, intentionally omitted or concealed this information, and/or deemphasized the actual risk of PAH associated with CoolSculpting, the lawsuit claims. 

In fact, ZELTIQ CoolSculpting commercials and advertisement materials touted the procedure as “easy as getting a pedicure” and listed few temporary side effects, if at all. The company also made similar claims on its Facebook page, omitting any mention of PAH risk, according to court documents.

    I was working for a Dermatologist in Beverly Hills. He was opening a new office and had the Cool Sculpt Rep visit our office to give a demo to anyone who was interested, He, of course, wanted us to sell the procedures to his patients. I allowed the rep to use my upper arms. I don’t know why I allowed it because there was nothing wrong with them that a few bicep curls wouldn’t fix. I now have the flappiest upper arms I have ever seen. They are impossible to hide and there are dresses, blouses and tops that I can no longer wear. Don’t do it!

      I used coolsculpting as well and left me disfigured. I used 2 procedures and never had my body been like this lumpy and mishaped. I thought it was safe and never thought I would be disfigure like this in my life..I regret doing it. Good for her she is bringing to their attention.
