Toyota Venza Windshields Class Action Lawsuit Overview:
- Who: Heather A. Davis and Robert Sweeny filed a class action lawsuit against Toyota Motor Sales, U.S.A., Inc.
- Why: Davis and Sweeny claim Toyota knowingly sold 2021 Toyota Venza vehicles containing defective windshields that can crack, chip or fracture for no or little reason.

Toyota sold 2021 Venza vehicles it knew contained defective windshields that can crack, chip or fracture, a new class action lawsuit alleges.
Plaintiffs Heather A. Davis and Robert Sweeny claim Toyota knew there was an issue with the Toyota Venza windshields during the manufacturing process but failed to fix the problem before selling the vehicles to the public.
“During the prerelease analysis stage of the Class Vehicles, Toyota would have known that the windshield chosen for the Class Vehicles was defective and would pose a safety risk to owners/lessees and the motoring public,” the class action lawsuit states.
Davis and Sweeny claim the windshields will either fail for “no reason at all” or due to an incident that would not cause an issue for a “non-defective windshield,” such as a “very slight impact.”
The defect often reveals itself immediately after a driver takes ownership of the vehicle, the class action lawsuit alleges.
Toyota Won’t Repair Defective Windshields Under Its Warranty, Class Action Says
Despite this, Toyota refuses to repair the windshields under its warranty, requiring vehicle owners to pay out of pocket for new windshields, which are also defective, causing the need for multiple replacements, the class action lawsuit alleges
Davis claims she has had to get four replacement windshields on her 2021 Toyota Venza within the span of one year.
In addition to causing financial injury, Davis and Sweeny argue the defect also puts the health of drivers, passengers and others on the road in danger.
“The Windshield Defect poses an extreme safety hazard to drivers, passengers, and pedestrians because a spontaneously shattering or cracking windshield can impair the driver’s view, distract the driver, and result in dislodged glass that can injure drivers, passengers and pedestrians,” the class action lawsuit states.
Davis and Sweeny claim Toyota is guilty of fraudulent concealment and unjust enrichment and in violation of the Magnuson-Moss Warranty Act, the Texas Deceptive Practices Act and the Arizona Consumer Fraud Act, among other things.
Davis and Sweeny want to represent a nationwide class and a Texas and Arizona subclass of individuals who are current or former owners or lessees of a 2021 Toyota Venza.
Plaintiffs are demanding a jury trial and requesting equitable relief along with actual, incidental, consequential and punitive damages for themselves and all class members.
Toyota has had issues with its Venza vehicles in the past. Last year, the company recalled 279,040 of its model year 2009-15 Toyota Venza SUVs over concerns their airbags may fail to deploy.

I jacked my 2021 Vanza up to change the tire and the windshield cracked
I just bought a used 2021 Venza and having it under a month a Little Rock touched it and it now has a crack. What is the status of this lawsuit is Toyota issuing a recall for their windshields?
I have a 2022 Venza that the windshield cracked when temperature was in the teens when it was left parked outside overnight. I will take it to Toyota this Monday and see what they say.
I bought a 2022 Venza in October off 2023. In January of 2024 the windshield cracked for no apparent reason. I am waiting to have it repaired and am just now finding out this has been an issue. I want to know if the class action lawsuit is filled.
It was a really very light hit I think the traffic was not that fast and a small stone hit the glass and it crashed. It crashed.. I have had really strong hits in my other cars and this was absurd
I also have a crack in my windshield on my 2021 Venza. I was with friends and we went to lunch. It was 100 degrees. We had lunch and when we left I turned the AC on high to cool the people in the back seat. When we returned home all was fine but when we went to diner several hours later the crack was there. No reason for the crack other than extreme temperature changes.

I’ve had to replace mine twice through insurance. Both times there was no memorable event that caused it to crack, both times in the same spot!
My windshield got hit by a small rock 1 month after I bought it. It Immediately cracked. I had to wait 6 months for a replacement as they didn’t have any in stock. Two weeks after replacing it ($1,200 out of pocket), it cracked AGAIN! TWO WEEKS!!! This windshield now has two separate cracks from two different rocks, and also two rock chips. Every single time it gets hit by a rock it fails. Clearly something is wrong and defective. I am refusing to replace this one because I’m scared to pay another $1,200 and have it fail again.
Windshield cracked while parked. No visible rock chops or damage at all. 2021 venza. This happened after only a few months. Took to dealership and submitted a complaint with Toyota but nothing came of it. I’ve been driving around with a huge crack in my windshield for a year now as I can not afford the price to replace.
Our 2021 Toyota Venza got a tiny hit from a pebble on the freeway…huge split from passenger side all the way to the middle of the driver’s side. Finally got it fixed through our insurance. Only has 21,000 miles on it.Love the car; hate that I am worrying about getting another crack. We would like to join the lawsuit.
