A Maryland woman recently filed a lawsuit against Tesla, claiming that she suffered traumatic brain injuries after the airbags in a Tesla Model 3 vehicle failed to deploy during a car accident.
Maryland Couple Files Tesla Airbag Lawsuit
According to the recent lawsuit filed against luxury vehicle and energy company Tesla, the company’s Model 3 automobile may be affected by a defect that causes the airbags to fail during collisions. Plaintiffs Kristian and Jason E. filed their suit against the company after experiencing a car crash in July 2019.
Kristian and Jason claim that Jason was driving the Tesla Model 3 in Maryland when the vehicle was struck on the passenger side by another car that had moved out of its lane. The crash was forceful enough that the Model 3 spun around, hit a guardrail, and was totaled.
Despite the seriousness of the crash, Kristian claims that none of the airbags in the vehicle deployed during the collision. This resulted in her head hitting the inside of the passenger compartment directly, rather than being cushioned by an airbag.
Due to this collision, Kristian claims that half of her skull had to be removed, and she was diagnosed with injuries including intracerebral hemorrhage, subdural hematoma, and diffuse axonal injury, or brain bleeding and damage to the nerve fibers within the brain. As a result of these injuries, Kristian claims to suffer from cognitive deficits, impaired mobility, and tetraplegia. She believes these injuries to be permanent.
According to Kristian and Jason, they had been led to believe by Tesla that the company’s vehicles were very safe. According to them, Tesla has made claims about the Model 3 indicating that it is the safest car ever built and that if you are driving a Tesla Model 3, you have the best chance of avoiding serious injury during a car accident.
Tesla Safety Complaints
Kristian and Jason are not the first people to claim that Tesla vehicles are not as safe as the company advertises. In addition to complaints about a potential Tesla airbag defect, the company has also come under fire for its autopilot technology.
Autopilot is a feature included on Tesla vehicles that allows the vehicles to steer, accelerate, and brake automatically in order to avoid collisions. Although the Autopilot feature is meant to provide drivers with an additional layer of safety, some Tesla drivers claim that Autopilot may malfunction.
Drivers have reported Autopilot allowing them to rear-end vehicles in front of them, or crash into highway barriers. One potential issue with Autopilot is that the system can only respond to dangers it is programmed to recognize. This may mean that the system is unable to detect or respond to potential threats it has not previously been exposed to.
