nissan vehicle in a dealership lotNissan has agreed to mediate a Nissan sunroof class action lawsuit with a consumer alleging that the glass feature can shatter without warning.

According to the agreement, the mediation session will be held on April 30 before former judge and experienced mediator James Warren of San Francisco.

The agreement comes only months after U.S. Magistrate Judge William Orrick ruled that plaintiff Linda Spry wasn’t bound by an arbitration agreement she signed when purchasing her vehicle.

Spry reportedly signed an arbitration agreement when she purchased her 2012 Nissan Murano from a California dealership in February 2013, but the agreement did not include Nissan as the manufacturer.

“Here, the dealership could have easily included Nissan as a third-­party beneficiary, but it did not. The plain language of the contract suggests intent to include a limited class of third parties who are involved in disputes arising from the purchase, leasing, servicing or contract negotiations with the dealership,” Judge Orrick said in a September response to Nissan’s arbitration motion.

“When a party who executed a contract or document could easily have designated a third­-party beneficiary but failed to do so, it is indicative of a lack of intent.”

The Nissan sunroof class action lawsuit was filed in February 2017, alleging that the glass features in Nissan vehicles have the tendency to shatter without warning.

The problem allegedly originates with the thin, tempered glass installed in sunroofs used in certain Nissan models as far back as 2008.

While other car manufacturers use laminated glass in their sunroofs, Nissan reportedly uses tempered glass and then lines the outer edge with a ceramic based paint.

Spry claims that the glass is weakened during the manufacturing process which can cause the sunroofs to shatter under normal circumstances.

Consumers have reportedly experienced their sunroofs shattering while driving at high speeds down an interstate or even simply driving down a normal road.

In May 2017, only months after the suit was first filed, Nissan sought to dismiss the suit. The car manufacturer claimed that the alleged flaws in the sunroofs were not covered by Nissan’s “materials and workmanship” warranty which specifically excludes “glass breakage” coverage.

Nissan also challenged other parts of the plaintiffs’ claims, including their fraud-based claims and their attempt to represent a nationwide Class.

However, Judge Orrick rejected this motion, finding that the plaintiffs had sufficiently alleged their claims.

The judge wrote that, while the claims were “somewhat bare,” amendments to the Nissan class action included specific details regarding advertisements from the Nissan dealership and discussions with dealership employees.

The drivers are represented by Gregory F. Coleman, Mark E. Silvey and Adam A. Edwards of Greg Coleman Law PC, and Mitchell Breit of Simmons Hanly Conroy LLC.

    I have a 2014 Nissan Murano. I am the only owner of this 2014 Murano. It currently has about 75000 miles. Yesterday my sunroof glass shattered for no reason. I was driving back home with my daughter on the road, when I heard this horrible loud crack. The front sunroof essentially shattered in on itself and tiny pieces of glass everywhere. The sunroof looked like something had exploded from the inside out! Nissan corporate office refuses to pay the repairs! I have read that other people with Nissan Murano’s have had the same experience.

      My wife has a 2015 Nissan Murano with almost 70k miles on it and last Friday, 4/9/2021, she we driving down the highway with no one around her when her sunroof spontaneously exploded with our 1 year old in the car. The dealership is refusing to pay for it even though we bought the vehicle there and purchased the extended warranty through them.

        Just an hour ago, my husband and I were driving on I-70 west and heard a loud
        explosion. We pulled off the highway to investigate and found that the moon-roof on our 2015 Nissan Murano was completely shattered. Thank goodness we had the sun protector closed or the back seat could have been full of glass. Very Scary. When I called Nissan, the Service dept. said that they never heard of the moon-roof glass spontaneously breaking. Really???

    Has anyone reported leaking sunroofs? My car has been leaking for about 4 years. Dealer worked on it several times. It’s a 2011 nissan altima. I see many complaints about the problem on the internet but no lawsuits. About 6 weeks ago i took car to another dealer thinking the water was coming from the radiator or windshield sprayer hose when i got my car back there was water under the front and back of the drivers side…very bad took almost 3 weeks to dry up. The next week it rained and the windshield was now leaking over the mirror.

    I have a 2019 Nissan Rogue haven’t had the sunroof glass shatter yet but my sunroof rattles and makes a squeaking/rattling noise took it to Nissan. Nothing wrong go figure! I just seen this issue on here and it makes me really concerned Now. Ugh

    My 2016 Nissan Rogue sunroof exploded with my great granddaughter, (3 months old) in back seat June 2020. The Nissan dealer wants $2,200 and they charged me $116.00 to tell me that. I don’t have that kind of money!!

    On May 25,2020. My grandson and I was doing down Hwy going home after camping. And out of the blue we heard a loud explosion. Didn’t know what happened until I pull over and saw the shattered sunroof and tiny pieces of glass everywhere. After my auto insurance investigated they said they wouldn’t cover repairs or car rental because it was a defect and nissans responsibility. So here I am I need help please

    On April 23rd, 2020. I was driving home from work on 1-44 in Oklahoma City in my 2016 Nissan Maxima Platinum. My Sunroof exploded. Scared me to death. It’s a wonder I did not crash. I pulled over and called 911. The police officer also verified this is what happened. I then start seeing all these other sunroofs with Nissan cars are doing the same. Is Nissan going to fix my car??

    My 2016 Nissan Juke Sunroof exploded today. Thanks goodness it was parked and I was not driving on Rt 80 to go to work. I am not happy that i am hearing this may be a defect with the material as i read further on this website.

    2019 Nissan Rouge moon roof just shattered, Out of no where. The glass clearly exploded up and out. Nissan is denying responsibility. What next?

    Ours recently exploded for our 2015 Murano. Please report to NHTSA.gov. I believe that if enough reports happen, then they can look into issuing a recall.
