  • A California federal judge certified most of the proposed classes of Mazda drivers in a hefty class action lawsuit against the carmaker.
  • The lawsuit alleges a water pump defect can lead to โ€œcatastrophic engine failureโ€ฆ at any time without prior warning.โ€ย 
  • On Oct 21, U.S. District Judge Josephine L. Staton filed an order granting the motion for class certification brought by owners of the Mazda 6 and Mazda CX-9 affected by the alleged faulty pump.ย 
  • She certified seven classes for vehicles purchased in California, Massachusetts, Michigan, Missouri, Ohio, Texas and Virginia, as well as a class for those alleging violations of Californiaโ€™s Song-Beverly Act.
  • The judge declined to certify classes of North Carolina and Louisiana drivers, saying plaintiffs from those states had not put forward arguments with standing under the statesโ€™ laws.

A group of 20 Mazda drivers filed a hefty class action lawsuit against the carmaker for a water pump defect that they say can lead to โ€œcatastrophic engine failureโ€ฆ at any time without prior warning.โ€ The defect has caused one fatal accident already.

The water pump defect occurs in the MZI Cyclone engine in the CX-9 for model years 2008 through 2015 and the Mazda6 for model years 2009 through 2013.ย 

The plaintiffs seek to represent a nationwide class of all persons or entities in the United States who purchased, leased or own a class vehicle. There are 12 state-specific subclasses for California, Florida, Illinois, Louisiana, Massachusetts, Michigan, Missouri, North Carolina, Ohio, Pennsylvania, Texas and Virginia. There are also two subclasses related to specific California state laws.ย 

Mazda allegedly knew about water pump defect since 2007

The defect detailed by the complaint involves the internal chain-driven water pump. The pump is meant to circulate coolant through the engine while the engine is running. However, the defect in question allows coolant to leak from the water pump into the oil pan and/or other engine components, mixing it with the engineโ€™s oil and leading to destruction of the engine.

The water pump is located deep within the engine behind several other components and would cost more than $1,500 to repair or replace, according to the complaint.

Plaintiffs argue that they and the class were not told about the potential defect. However, Mazdaโ€™s internal data indicates that the company began receiving reports of water pump failures in class vehicles by at least June 2007, according to court documents. Mazda received at least 58 warranty claims for failed water pump failures in 2009. Complaints were also made to the National Highway Traffic Safety Administration.

The plaintiffs seek class certification and approval of class counsel, declaratory relief, an order preventing Mazda and other defendants from continuing their allegedly unlawful behavior, injunctive and equitable relief, damages, statutory and civil penalties, pre- and post-judgment interest and attorneysโ€™ fees.ย

    Our 2013 CX-9 joined the ranks with a dead water pump. In no way can we afford to fix this or buy another. Would have been awesome to know this was on the horizon.

    Purchased a Mazda 2015, CX-9 Sport, 10/2/21 and on 7/31/23 the water pump gave way and the engine was deemed โ€œblownโ€. Coolant was leaking from the top of the engine. I attest to proper maintenance and upkeep of the vehicle. So disappointing, I loved this SUV. I still owe on the vehicle and Mazda is the fault of my financial problems.

    I just bought a 2013 CX-9 in October 2022 with 86K miles on it. Yesterday, she started rattling. Got her into the shop to be told I needed a new engine. Iโ€™m flabbergasted. I owe like 4 more years of payments and need an ENGINE?!?

    On 5/29/2023 my 2012 Mazda CX-9 had this exact thing happen! Currently my car is at Mazda Service and hoping they will do the right thing as they are telling me I need a new engine.

    This happened to me last year was forced to sell my car with a blown engine for a few dollars. So I could put a down payment on a new car. I had just payed my mazda 6 off and thought Iโ€™d be driving it for years more payment free. Mazda is no longer getting my business or anyone that I come across.

    My car did the same water pump failure on February 14 2023 and i took my car to mazda a couple days before that because my car was making noise they said they could not find the problem record the noise next time and bring it back well when i brought the car back a couple days later they said water pump failure $6,000 for the engine $3,500 for labor but after reading all the comments Mazda was already full aware of this situation and did not say anything โ€ฆthis has been a big inconvenience to everyone and they should stand up and take responsibility for what they have done to people i had to go to the emergency room and was not able to use my car to be taken there i have to take the bus to work daily โ€ฆ Mazda you are wrong for this, i was so happy to buy my 2012 brand new, all to be disappointed in the end you do not care about your customers you are a scam and i will never buy or recommend a Mazda to anyone โ€ฆ STAND UP AND TAKE RESPONSIBILITY AND MAKE THIS RIGHT MAZDA โ€“ YOU HAVE OUR MONEY AND WHAT DO WE HAVE ,NOTHING !!!!!!!!!!!!!!!!

    My Mazda failed with no prior warning on June 9, 2019. My fianceโ€˜ was driving on the interstate when it came to a stop and was nearly rear-ended. We had the car towed to the dealer. I called Mazda and they said they would not do anything. I was told that they did not get many complaints about it. It was a wasted purchase. I did not get the life out of a vehicle that should have.

    The same thing happened to me. I had taken my 2015 CX9 with less than 100,000 miles on it to the dealer in January earlier to get it inspected and told them that once or twice it seemed to be running hot. They added coolant, inspected it, and said it was fine. In the middle of February I was driving my car which was making a slight hum (this started the day before it went out). As I exited the interstate, it seized up and I lost steering and brakes. I had it towed to the same Mazda dealership, and they told me it was a water pump failure. Coolant had mixed with the oil, looked like chocolate milk. They quoted me the price on that fix, and then told me that most likely I needed a brand new engine. This car was supposed to last at least 10 more years. I was planning on buying many more Mazdaโ€™s but now the chances of me doing that are zero! If Mazda doesnโ€™t want to take responsibility, then perhaps we all need to get together and start a Facebook campaign. Social pressure can be very powerfulโ€ฆ
