  • A California federal judge certified most of the proposed classes of Mazda drivers in a hefty class action lawsuit against the carmaker.
  • The lawsuit alleges a water pump defect can lead to โ€œcatastrophic engine failureโ€ฆ at any time without prior warning.โ€ย 
  • On Oct 21, U.S. District Judge Josephine L. Staton filed an order granting the motion for class certification brought by owners of the Mazda 6 and Mazda CX-9 affected by the alleged faulty pump.ย 
  • She certified seven classes for vehicles purchased in California, Massachusetts, Michigan, Missouri, Ohio, Texas and Virginia, as well as a class for those alleging violations of Californiaโ€™s Song-Beverly Act.
  • The judge declined to certify classes of North Carolina and Louisiana drivers, saying plaintiffs from those states had not put forward arguments with standing under the statesโ€™ laws.

A group of 20 Mazda drivers filed a hefty class action lawsuit against the carmaker for a water pump defect that they say can lead to โ€œcatastrophic engine failureโ€ฆ at any time without prior warning.โ€ The defect has caused one fatal accident already.

The water pump defect occurs in the MZI Cyclone engine in the CX-9 for model years 2008 through 2015 and the Mazda6 for model years 2009 through 2013.ย 

The plaintiffs seek to represent a nationwide class of all persons or entities in the United States who purchased, leased or own a class vehicle. There are 12 state-specific subclasses for California, Florida, Illinois, Louisiana, Massachusetts, Michigan, Missouri, North Carolina, Ohio, Pennsylvania, Texas and Virginia. There are also two subclasses related to specific California state laws.ย 

Mazda allegedly knew about water pump defect since 2007

The defect detailed by the complaint involves the internal chain-driven water pump. The pump is meant to circulate coolant through the engine while the engine is running. However, the defect in question allows coolant to leak from the water pump into the oil pan and/or other engine components, mixing it with the engineโ€™s oil and leading to destruction of the engine.

The water pump is located deep within the engine behind several other components and would cost more than $1,500 to repair or replace, according to the complaint.

Plaintiffs argue that they and the class were not told about the potential defect. However, Mazdaโ€™s internal data indicates that the company began receiving reports of water pump failures in class vehicles by at least June 2007, according to court documents. Mazda received at least 58 warranty claims for failed water pump failures in 2009. Complaints were also made to the National Highway Traffic Safety Administration.

The plaintiffs seek class certification and approval of class counsel, declaratory relief, an order preventing Mazda and other defendants from continuing their allegedly unlawful behavior, injunctive and equitable relief, damages, statutory and civil penalties, pre- and post-judgment interest and attorneysโ€™ fees.ย

    My car didnโ€™t give any warning was running fine. When all of sudden at a red light it started knocking and my temperature gauge rose quickly from warm to hot. I was told by a mechanic it was most likely the internal water pump. My car had 122k and had always been well maintained. Chose not to fix because of cost. My car was a 2012 and looked in excellent condition.

    Iโ€™m here for the same reason! Upwards of 10,000 maybe more for repair. My Mazda cx9 is a 2010 with 160,000 miles but has never had a problem until now other than regular maintenance and a few sensors. Now with no warning my engine needs replacing?? I couldnโ€™t understand and then I found out this is on going with apparently everyone.

    2013 cx9 90,000 miles ! Paid for an 8 yesr extended warranty! Had all service done at Liberty Mazda in Wakefirld Massachusetts ! Same as everyone above! 10 K quote for new engine ! Plus they want 169.00$ for diagnosis!

    Bought 2015 cx9 with 132k in may 2020 and November 2021 water pump failed and destroyed my engine with no warning of any kind. It cost me 6,500$ for a used 2014 engine to replace it!!! O had to take out a separate loan just to cover the repair costs and I was still paying off my car before it happened.

    My 2014 cx9 just blow motor had 122 thousand miles on it and maintained it very well now dealership want 11 thousand to replace it of $700 for trade when I still owe $8000 to pay yet can I please be apart of this lawsuit please

    2014 Mazda cx9 in 2021 water pump failed on highway at just over 100000 miles and destroyed the engine and stranded my son on his way home from college. We were forced to trade a 12000 car in for

    I just joined the group 3 days ago on 9 October 2022. My 2014 Mazda CX-9 which had 140,000 miles had the water pump disintegrate Saturday. The dealership is quoting me over $11,000 to replace the engine. When queried the mechanic did not offer anything when asked, โ€œIs this a thing with Mazda?โ€ Obviously it is.

    2015 cx9. Same issues as above quoted new engine for 10000 by dealership for water pump failure. Suggestion from maintenance dept to just call junkyard.

      Same problem with 2010CX9. Quote of $10,000 to replace motor. Water pump inside of motor which from the beginning was a recipe for disaster. Car has been sitting in my garage for over a year. Looks like new interior and exterior. What are we to do? I also had a 2008 that did the same thing.

    Seems like this list is never ending and I am getting added to the list as well.

    2014 CX-9 Grand Touring, Engine Lights On, Dealership quoted 13k+Tax with a 12 month repair warranty, cause is the same water pump leakage and engine needs to be replaced as a result.
