Friday is the deadline to file a claim in this Canadian auto parts price-fixing class action lawsuit settlement.

A group of auto parts manufacturers and distributors have agreed to pay about $102.5 million to settle allegations of Canadian auto parts price-fixing.  

The class actions include any person in Canada who purchased or leased a new vehicle containing the relevant parts or who purchased the relevant parts for installation in a new vehicle. A number of Canadian auto parts price-fixing class action lawsuits were filed against a number of defendants over allegations that the companies conspired to inflate prices for a variety of consumers including car makers, dealers, and individual consumers. According to the class action lawsuits, the parts with inflated prices were essential components of new vehicles.  

The Canadian auto parts price-fixing settlements cover about 45 class action lawsuits, including the following, according to the class counsel website.

Air Conditioning Systems, Air Flow Meters, Alternators, Anti-Vibration Rubber Parts, Autolights, Automatic Transmission Fluid Warmers and Oil Coolers, Automotive Brake Hoses, Automotive Exhaust Systems, Automotive Steel Tubes, Bearings, Braking Systems, Body Sealing Parts, Ceramic Substrates, Constant Velocity Joint Boot, Electric Powered Steering Assemblies, Electronic Control Units (ECU), Electronic Throttle Bodies, Fan Motors, Fuel Injection Systems, Fuel Senders, Heater Control Panels (HCP), High Intensity Discharge Ballasts (HID Ballasts), Hoses, Ignition Coils, Instrument Panel Clusters (IPC), Inverters, Manual Steering Columns, Motor Generators, Occupant Safety Systems (OSS), Oxygen Sensors, Plastic Interior Trim, Power Window Motors, Power Window Switches, Radiators, Shock Absorbers, Spark Plugs, Starters, Steering Angle Sensors, Switches, Windshield Washer Systems, Windshield Wiper Systems, Wire Harness Systems. 

Courts in Ontario and Quebec are currently scheduled to hold final hearings on the Canadian auto parts price-fixing class action settlements. Some settlement agreements have already been approved by British Columbia, Ontario, and Quebec courts. However, the defendants do not admit any wrongdoing or fault. 

The Class periods and further descriptions of the parts that are covered by the Canadian auto parts price-fixing settlements are also available on the settlement website. Most of the parts covered by the settlement agreements were sold between 2000 and 2019.  

Class Members will each receive a proportionate share of the settlement funds, after administrative costs and legal fees are paid. Each award will be based on the Class Member’s vehicle and the category that the Class Member falls into.  

According to the Canadian auto parts price-fixing settlements notice, Class Members will be categorized as either National Brand Importers, Dealers, or End Users.  

National Brand Importers include Toyota Canada Inc., Honda Canada Inc., Nissan Canada Inc., and Subaru Canada, Inc. Dealers include those who purchased a vehicle affected by the alleged price-fixing scheme from a National Brand Importer or a subsidiary for eventual resale to customers. End Users include the customers who bought or leased one of the vehicles allegedly affected by the scheme.  

Under the terms of the Canadian auto parts price-fixing class action settlement, all valid claims will be assigned a minimum of $25. Each Class Member’s award will depend on the purchase price of their vehicle(s) and the category they fall into. 

Certain Class Members may need to apply to receive settlement benefits.  

The deadline for certain Class Members to exclude themselves from the Canadian auto parts price-fixing class action settlement has already passed; however, Class Members covered by the Air Conditioning Systems and Automotive Exhaust Systems settlement classes can still opt out, but must do so by March 24, 2020.  

The deadline to file a claim is June 12, 2020

Who’s Eligible

Any person in Canada who purchased or leased a new vehicle containing the relevant parts or who purchased the relevant parts for installation in a new vehicle.

Potential Award

All valid claims will be assigned a minimum of $25. Each Class Member’s award will depend on the purchase price of their vehicle(s) and the category they fall into. 

Proof of Purchase

When filing a claim, Class Members may be required to provide purchase records for the affected vehicle(s). In some cases, purchases may be established on sales records provided by the automotive dealerships.

    Can you guys please add me. I do have wiring issue on my 2014 nissan rogue. I spend $1950cad for engine ECM already and the dealership asking for another $3300cad engine wiring harness. Now i can’t use my car coz i can’t afford the expensive parts. Even dealership can’t provide and statement for causing this issue. They can’t find any signs of burnt wires.
