Consumers who purchased Black+Decker and Farberware small appliances may be eligible to participate in a new class action lawsuit settlement.

The small appliances class action argued that Black+Decker and Farberware misrepresented that certain covered products are manufactured and warranted by the companies, when they are not.

Plaintiffs also claims that certain coffee makers produce less coffee than they are advertised to. The coffee makers in questions allegedly produce a certain number of “cups,” but the plaintiffs argued that these cups were not the standard 8 fluid ounce cup that most consumers allegedly assume.

According to the class action lawsuit, Black+Decker as well as Farberware are known brand names “synonymous with quality, engineering, and performance.”

However, defendants Spectrum Brands Holdings Inc. and Applica Consumer Products Inc. obtained a license to use these brand names on various kitchen appliances and sell them online and in stores like Walmart, Home Depot, Sears and Target.

Spectrum Brands Holdings and Applica Consumer Products repeatedly and consistently refer to their appliances as “genuine” Black+Decker- and Farberware-made products when in fact, they are not, according to the class action lawsuit.

The plaintiff states that had he known the kitchen appliances were not true Black+Decker or Farberware products, he never would have purchased them.

Under the settlement, consumers who purchased certain items between Feb. 5, 2014, and Oct. 19, 2018, may be eligible to recover compensation. Eligible purchases include:

  • Black+Decker branded: air fryers, blenders, can openers, coffee grinders, coffee makers, electric knives, food processors, grills, irons, juicers, kettles, mixers, quesadilla makers, rice cookers, skillets and other surface cookers, slow cookers, toasters, toaster ovens, and waffles
  • Farberware branded: coffee urns and percolators, food processors, and toaster ovens

Eligible Class Members who submit a valid claim, either through the mail or through the settlement website, will be entitled to recover a partial refund of up to $4. Valid claim submissions must be submitted by Feb. 28, 2019.

No wrongdoing has been determined in court, and the small appliances class action has instead been settled. The defendants admit no wrong in settling the small appliances class action lawsuit.

The small appliances settlement will also provide plaintiff Steven Liptai with a $2,500 service payment for his work as Class Representative. Class counsel reportedly plan to ask for up to $550,000 in attorneys’ fees and up to $10,000 in costs/expenses.

The final approval hearing is scheduled for March 22, 2019 and will determine whether or not the settlement will move into the final payment and distribution stages.

Who’s Eligible

Consumers who purchased certain Black+Decker and/or Farberware brand small kitchen appliances between Feb. 5, 2014 and Oct. 19, 2018.
