Fashion company Ralph Lauren advertises false price discounts for merchandise sold throughout its Polo Factory outlet stores, a new class action lawsuit alleges.
Plaintiff Sarah Ratra’s class action lawsuit claims Ralph Lauren engages in what is known as false reference pricing to make consumers think they are getting a greater discount on for sale items than they actually are.
“Aware of the intertwined connection between consumers’ buying decision processes and price, retailers like Defendants lure consumers with advertised discounts that promise huge savings and high value,” the Ralph Lauren class action says.
Ratra wants to represent a California class of consumers who purchased one or more products from a Ralph Lauren Polo Factory outlet store at a discount from an advertised reference price and who have not received a refund or credit for their purchase(s).
Ralph Lauren uses inflated reference prices for discounted items at Polo Factory outlet stores, class action claims
Ratra argues Ralph Lauren uses reference prices for discounted items that are higher, made-up and artificially inflated beyond what any has paid for them.
“Consumers are thus damaged not only by not receiving the promised discount, but by paying a premium the products would not have commanded but for the false reference pricing scheme,” the Ralph Lauren class action says.
Ratra claims Ralph Lauren is violating California’s Unfair Competition Law and Consumers Legal Remedies Act. She demands a jury trial and requests declaratory and injunctive relief and an award of actual, punitive and/or statutory damages for herself and all class members.
A consumer filed a separate class action lawsuit against Ralph Lauren at the end of last year over claims the company failed to make its website fully accessible to and independently usable by individuals who are blind or visually impaired.
