The owner of Ann Taylor Factory Stores and LOFT Outlet advertised false price discounts for merchandise sold in the stores, a new class action lawsuit claims.ย
Plaintiff Deborah OโDea claims Premium Brands Opco LLC lured consumers with advertised discounts that actually came from an โhigher, made-up, and artificially inflated โoriginalโ priceโ that โno one ever pays.โย
โThis practice artificially inflates the true market price for these products by raising consumersโ internal reference price and in turn the perceived value consumers ascribe to these products,โ the class action argues.ย
OโDea wants to represent an Oregon class of consumers who purchased a product at an Ann Taylor Factory Store or LOFT Outlet that was discounted from an advertised reference price and did not receive a refund or credit for that purchase.ย

OโDea claims Premium Brands Opco schemed to sell products at its Ann Taylor Factory Stores and LOFT Outlet stores above their true market price and value, leaving consumers to โpay the inflated price regardless of what they thought of the purported discount.โย
โConsumers are thus damaged not only by not receiving the promised discount, but by paying a premium the products would not have commanded but for the false reference pricing scheme,โ the class action says.ย
OโDea argues Premium Brands Opco is in violation of Oregonโs Unlawful Trade Practices Act. She demands a jury trial and requests declaratory and injunctive relief along with an award of actual, punitive and statutory damages for herself and all class members.ย
A group of consumers filed a similar class action lawsuit against Home Depot last month over claims the company advertises products at a false discount in an effort to mislead consumers.ย
