A settlement valued at nearly $4.5 million has been reached, ending claims that Fossil misrepresents pricing within its California outlet stores.

Class Members include those who purchased outlet exclusive products at any Fossil outlet store in California between Sept. 13, 2013 and May 3, 2019.

According to the Fossil class action lawsuit, the tags on certain items exclusive to outlet locations included deceptive comparative pricing information, known as false reference pricing.

The complaint alleged that consumers were duped into thinking they were saving money off of items that were put up for sale in regular Fossil retail locations.

However, the outlet items were not actually sold at any retail locations at any price, much less at the comparative price included on the tags.

The Fossil outlet pricing class action lawsuit contends that consumers would not have purchased or paid so much for the deceptively marketed goods had they known they were not regular retail items offered at a discount.

Further, Fossil allegedly violated California law that requires an item to be sold at the price included on comparative pricing dates within a certain timeframe.

For its part, Fossil admits no wrongdoing, but has agreed to pay Class Members $4.488 million in merchandise certificates to end the outlet pricing class action lawsuit.

Under the terms of the Fossil outlet pricing class action settlement, Class Members can receive a voucher for $11 off any purchase. Class Members who receive notice will automatically get the coupon, but those who do not receive a notice of the settlement will need to file a claim. Class Members who file claims must also include proof of purchase.

The deadline to object to or opt out of the Fossil outlet pricing class action settlement is Aug. 1, 2019.

Who’s Eligible

Class Members include those who purchased Fossil outlet products at a California store between Sept. 13, 2013 and May 3, 2019.

Potential Award

$11 voucher.

Receipts or bank statements with date and location of purchase.
