A class action settlement has been reached that would end allegations that New Jersey Burlington Coat Factory locations used reference prices that were fake — the items had never been offered for sale at the price listed.

The plaintiffs said that the fake pricing tricked consumers into thinking they were getting a deep discount.

New Jersey residents who made a purchase at a Burlington Coat Factory location within the state between June 26, 2011 and May 22, 2017, can get a $5 store purchase certificate from this class action settlement.

Purchases need to have been made in-store and not returned for a refund or credit.

Lead plaintiffs alleged that New Jersey Burlington locations contained false “reference pricing” on their sales tags. Reference pricing refers to price tags that indicate the item was sold for another price, usually much higher, at a different retail location.

Further, the Burlington class action lawsuit claimed that consumers would not have decided to purchase the items had they known the products were never offered for sale at the reference price listed on the price tag.

On its website, Burlington boasts that “you’ll find a large assortment of current, high-quality, designer and name-brand merchandise at up to 60% off other retailers’ prices.” The chain, found throughout the United States, agreed to settle the class action lawsuit, but admits no wrongdoing.

Under the terms of the Burlington class action lawsuit, Class Members can receive a store credit worth $5 toward a new purchase at a New Jersey location.

Class Members who are claiming more than $500 in purchases can claim an additional $5 purchase credit if they provide proof that can be used to verify their purchase. Proof of purchase can include receipts or debit/credit card statements clearly indicating the amount of the transaction.

Purchase credits, under the class action settlement, are valid for one year.

Claim Forms can be submitted online or printed and mailed by June 6, 2019.

Burlington customers who want to object to the settlement or wish to be excluded from it have until March 20, 2019 to do so.

Who’s Eligible

Class Members include “All New Jersey citizens who made one or more in-store purchase(s) at a Burlington store located in New Jersey between June 26, 2011 and May 22, 2017, and did not receive a refund or credit for their purchase(s).”

Potential Award

$5 to $10 Burlington Purchase Certificate.

Proof of Purchase

Class Members claiming more than $500 in purchases will need to submit receipts or a credit/debit card transaction record in order to receive a second purchase credit worth $5.

    SO I get my $5 card and cant even use it bc I no longer live in NJ! Cant use online but what about disabled claimants!!??? Waste of time

    So you’ll go to the store spend 100 and save 5, sounds like good for business and free advertising to me..don’t forget you get an additional 10% if you get a credit card! ?
