Metals USA recently agreed to pay $2.8 million to resolve claims that Dura-Loc roofing panels failed long before the 25-year anticipated lifespan.
The settlement will benefit individuals who owned a home or other structure in California on which the continental, shadow line, or wood shake panels manufactured by Dura-Loc were installed between July 1, 1996 and May 12, 2006.
Plaintiffs James Wilson and Jack White filed their lawsuit against Metals USA Inc. in March 2012. The two allegedly purchased Dura-Loc roofing tiles for their homes in 2004.
When purchasing, the two men reportedly relied on representations that the tiles were UV resistant and would last for at least 25-years.
Despite these representations, the plaintiffs’ tiles allegedly deteriorated due to a defect known as “degranulation.” This reportedly causes the bonding on the tiles to degrade when exposed to UV rays, causing the stone portion of the tile to detach from the metal substructure.
Wilson and White argued that this defect directly contradicts the claims made by Metals USA. The company does not admit any wrongdoing by settling the claims against them. Instead, the settlement provides an opportunity to avoid the risks and costs of trial.
Class Members can receive $10 for each defective panel, for up to 300 panels, if they file a valid claim by June 14, 2019. Proof is required along with a valid claim. The complete list of documentation is available in the “Proof of Purchase” section below.
The deadline for exclusion and objection is June 14, 2019.
Who’s Eligible
Individuals who owned a home or other structure in California on which continental, shadow line, or wood shake panels manufactured by Dura-Loc were installed between July 1, 1996 and May 12, 2006.
Potential Award
$10 per each defective panel for up to 300 panels, equaling a total max award of $3,000.
Proof of Purchase
Any of the following if the consumer has them:
- Manufacturer warranty
- Proof of registration of manufacturer warranty
- Inspection report(s)
- Bills of sale
- Purchase orders
- Installation records
- Correspondence acknowledging product on roof or home or structure
- Photographs of installation
- Written notice to Dura-Loc of any transfer of the property to a subsequent owner
