Alaska residents have secured a $162,500 Fred Meyer class action settlement resolving claims that the retailer charged customers a “core fee” if they purchased a new lead/acid battery without turning in an old battery for recycling.
Those who purchased a lead or acid battery for ATV, motorcycle, garden, auto, or marine use from a Fred Meyer store in Alaska between Dec. 13, 2014 to Jan. 31, 2017, could get cash from this settlement.
Lead plaintiffs alleged that Alaska Fred Meyer locations falsely collected a core fee for auto batteries, as well as other lead/acid batteries.
According to the Fred Meyer class action lawsuit, stores in the state posted signs telling consumers that they were obligated to charge a core fee on batteries purchased at the store if the consumer did not turn in an old battery when making the purchase.
The Alaska Fred Meyer auto battery class action lawsuit states that the fees ranged from $5 to $15 per battery.
However, the store allegedly assessed the fee in violation of the Alaska Unfair Trade Practices Act and Consumer Protection Act. In fact, claimed the plaintiffs, Alaska does not assess a core fee on lead batteries.
Fred Meyer agreed to pay $162,500 to end the auto battery class action lawsuit. The amount each Class Member is awarded under the terms of the settlement will depend on the type of battery purchased; auto and marine battery claims will receive $30 each; ATV/motorcycle battery claims will receive $10 each; and garden battery claims will receive $16 each.
Class Members who have a store rewards card with Fred Meyer with a record of the battery purchase will automatically receive an award in the mail if the settlement is approved. The store rewards card must be associated with the Class Member’s correct address.
Class Members without a store rewards card must provide proof of purchase to the settlement administrator.
The deadline to object to or opt out of the Alaska Fred Meyer auto battery class action settlement is May 10, 2019.
Who’s Eligible
Class Members include consumers who purchased a lead/acid battery from an Alaska Fred Meyer between Dec. 13, 2014 and Jan. 31, 2017 and were assessed a core fee for not returning a used battery at the time of the purchase.
Potential Award
$10 to $30.
Total payment amounts will be calculated as follows:
- Auto and Marine Battery purchasers will be paid $30 each
- ATV/Motorcycle Battery purchasers will be paid $10 each
- Garden Battery purchasers will be paid $16
Proof of Purchase
Class Members without a current Fred Meyer customer card must provide proof of purchase, including a receipt or bank or credit card statement.
