Iowa Grain Processing Corporation Class Action Settlement

A $45 million settlement has been reached in a Iowa Grain Processing Corporation class action, resolving claims that the plant was a nuisance to homeowners.

The 2012 Iowa Grain Processing Corporation class action lawsuit claimed that the company’s plant in Muscatine, Iowa was irritating to the surrounding area due to the smoke, odor, and haze which it produced. These claims were recently resolved through a settlement, in which Grain Processing Corporation will pay $45 million.

Class Members are eligible for the settlement if they meet several requirements, including:

1. “You lived at a property in the Class Area for any period between April 24, 2007, and September 1, 2017; and
2. You were either a renter or owner of the property, or a dependent of the property’s renter or owner during that time period; and
3. You are not employed by GPC with a job title of Manager, Director, Vice President, Senior Vice President or President; and
4. You did not opt out of the class action in 2017. Opt-outs include any minor child for whom no Legal Guardian remains a Class Member.”

A map of the Class Area is available on the settlement website to help consumers determine if they are eligible for participation in the settlement.

Compensation will be determined by proximity of the Iowa Grain Processing Corporation plant, level of modeled air population at the Class Member’s property, and how long the Class Member lived there.

The Iowa Grain Processing Corporation settlement will also cover the installation of anti-pollution measures at the plant over the next five years. These measures will aim to reduce emissions and odor which prompted the class action lawsuit.

Class Members who want to object to the terms of the settlement must do so by Jan. 3, 2019.

Who’s Eligible

Individuals who lived, in Muscatine, Iowa, within 1.5 miles of the Grain Processing Corporation plant located at 1600 Oregon Street, at any time between April 24, 2007 and Sept. 1, 2017.

Potential Award

$2,000 – $16,000

“The estimated payment range for Claimants who lived in the areas with the highest modeled concentrations of pollutants is $12,000 to $16,000 per individual.  The estimated payment range for Claimants who lived in properties with mid-level modeled concentrations of pollutants is $6,000 to $8,000 per individual.  The estimated payment range for Claimants who lived in the areas with the lowest modeled concentrations of pollutants is from $2,000 to $4,000.”

• Utility bill
• Other documentation that the settlement administration deems reliable
