Bell Childrens Bike Seat Class ActionBell Sports, a company that makes a variety of sporting goods and equipment, has been the target of Made in the USA lawsuits over their Bell Copilot Limo Child Seat.

According to the class action lawsuit, Bell Sports deceptively used Made in the USA labeling on their Bell Copilot Limo Child Seat and other children’s bike seat products.

The lawsuit claims that the Bell Copilot Limo Child Seat and other similar products were sold with false Made in the USA labeling, despite not actually being made in the USA. Instead, these children’s bike seats were assembled from a wide variety of foreign-made parts.

Advertising products as Made in the USA or similar variants when products are actually made from foreign components violates state laws, since the lawsuit was filed in New Jersey, and federal laws.

A number of Bell Sports products, including the Bell Copilot Limo Child Seat, were allegedly advertised with this inaccurate Made in the USA labeling, according to the lawsuit.

Made in the USA Labeling

Federal and New Jersey state laws alike prohibit companies, including Bell Sports, from advertising their products as Made in the USA or Made in America, as well as similar phrases, when a significant portion of the product’s parts are manufactured outside the United States.

Unfortunately, companies have become aware that products labeled with Made in the USA can be more desirable than the same product without the label.

For some consumers, buying Made in the USA products aligns with their desire to support American jobs and to avoid supporting poor labor conditions in other countries. For others, it is simply another way to show patriotism.

Because of these factors, it is common for companies to use Made in the USA labeling to gain a competitive edge over rival products. Unfortunately, some companies do this even when products are not actually or wholly made in the United States.

Bell Copilot Limo Child Seat Class Action Lawsuit

A class action lawsuit has already been filed against Bell Sports that accuses the sporting goods company of violating both New Jersey and federal laws, actively misleading consumers about the foreign manufacturing background of the Bell Copilot Limo Child Seat and other products labeled Made in the USA.

According to the Bell Children’s Bike Seat class action lawsuit, “The ‘Made in USA’ claim is prominently printed on the product packaging along with an image of the American flag…Despite true facts to the contrary, the offending children’s bicycle seats are made, manufactured, or produced from component parts that are manufactured outside the United States.”

The consumer class action lawsuit alleges that the bicycle seat cushion is made in China, while the rack is made in Taiwan. Even if the components were eventually assembled in the United States, the lawsuit explains that since the foreign components make up a significant portion of the Bell Copilot Limo Child Seat, it cannot be lawfully advertised as Made in the USA.
