A California state court judge has preliminarily approved a class action settlement concerning Good Karma Food Inc.’s (successor in interest to Good Karma Food Technologies Inc.) labeling of its flax milk products as “natural.” The case is Larry Tran, et al. v. Good Karma Food Technologies Inc., et al.

If you purchased Good Karma brand flax milk beverages in California at any time between Oct. 20, 2010 and May 30, 2015, you may be eligible to claim a cash payment of between $0.25 and $3 per carton, up to a maximum of 10 cartons — for a potential maximum award of $30.

The varieties included in the Good Karma flax milk settlement include:

1. “Classic” Flax Milk (which comes in Original, Vanilla, and Unsweetened flavors) in the Half Gallon (1.89 L) size;

2. “Protein Plus” Flax Milk (which comes in Unsweetened Original and Unsweetened Vanilla flavors) in the Half Gallon (1.89 L) size; and

3. “Flax Delight” Flax Milk (which comes in Original, Vanilla, and Unsweetened Original flavors) in the 1.89 L or 946 mL size.

If final approval is granted, the Good Karma flax milk settlement will resolve allegations raised by plaintiff Larry Tran that he and other consumers purchased the products based, at least in part, on the statements printed on the products’ packaging stating that the products are natural.

According to Tran’s allegations, however, the products contain, as identified on the carton labels, ingredients which Tran contends are artificial and/or synthetic, including: Tricalcium Phosphate, Xanthan Gum, Vitamin A Palmitate, Vitamin D2, and Vitamin B12 (the “Challenged Ingredients”).

Tran alleges that, based on these statements, he and others believed the Good Karma flax milk products were “natural” and contained no artificial or synthetic ingredients, and had they known that the products contained the Challenged Ingredients, they would not have purchased the products.

The Defendants deny all allegations of wrongdoing and liability and contend that the “natural” statements used in conjunction with the statement “*added vitamins & minerals” do not represent that the added vitamins and minerals are “natural.” Defendants also maintain that a reasonable consumer would not be misled into believing that the products were all natural..

In order to avoid the expense and uncertainty of litigation, however, the parties have agreed to a $350,000 settlement and labeling restrictions to resolve the litigation.

A Final Approval Hearing is scheduled for Aug. 25, 2016.

Who’s Eligible

Class Members of the Good Karma Flaxmilk settlement include all persons who made an in-person purchase in the State of California, or an an internet or phone purchase for delivery to a California address, of any of the following products during the period from Oct. 20, 2010, up to and including May 30, 2015:

1. Good Karma “Classic” Flax Milk (which comes in Original, Vanilla, and Unsweetened flavors) in the Half Gallon (1.89 L) size;

2. Good Karma “Protein Plus” Flax Milk (which comes in Unsweetened Original and Unsweetened Vanilla flavors) in the Half Gallon (1.89 L) size; and

3. Good Karma “Flax Delight” Flax Milk (which comes in Original, Vanilla, and Unsweetened Original flavors) in the 1.89 L or 946 mL size.

Potential Award

Up to $30. For each carton of the Classic Flax Milk, a Settlement Class Member may seek reimbursement for $3 per carton. For each carton of the Protein Plus Flax Milk or Flax Delight Flax Milk, a Settlement Class Member may seek reimbursement for $0.25 per carton.

The maximum cash recovery is limited to 10 cartons per claimant. You may make a claim for one type of Product or, alternatively, may make a claim for a combination of different Products (i.e., can assert a claim for Classic, Protein Plus, and/or Flax Delight Products).

However, regardless of the Product(s) identified in the claim form, you may only obtain cash recovery for up to, and no more than, 10 cartons of Products. In the event a claim form identifies more than 10 cartons of Products, that claim form will be treated as though the first 10 cartons identified in the Claim Form are the only Products for which a claim is made.

Only one Claim Form is allowed per person and per address.

If the value of Eligible Claims exceeds the Net Settlement Fund, then each claimant’s award will be proportionately reduced so that the total paid claims does not exceed the Net Settlement Fund.

Proof of Purchase

You must provide the following information with your claim to prove that you purchased the product(s):

  • Identify one or more of the Products purchased and the name of the retailer from which each Product was purchased.
  • Your signature, under penalty of perjury, that you purchased the Product(s) indicated.

If you have an out-of-California address, you must:

  • assert that you purchased one or more Products in California or for delivery to a California address, and
  • must additionally identify the dates when you were in California and made the purchase(s), and
  • for any purchase(s) made for delivery to a California address, must identify the delivery address in California.

    this settlement did not pay a friend who did a claim, yesterday she received 18 cents all they gave her, the stamp, envelope was more then what they pay her, it was embarrassing, why waste paper, and she lived in California, wow, every one else got 19.00 and one 5.97. why send her anything at all 18 cents…all she got..
