UCLA Health Data Breach Class Action Settlement

A $7.5 million class action settlement has been reached, resolving claims that a July 2015 data breach exposed personal information stored by the UCLA Health Network.

The UCLA Health class action settlement provides $2 million to pay for unreimbursed loss claims and preventative measure claims. In addition, UCLA Heath has agreed to set up a cybersecurity enhancement fund of $5.5 million.

Class Members include those whose personal information was exposed or could have been exposed to hackers in the data breach affecting the UCLA Health Network in 2015.

The UCLA Health Network is an academic medical center that serves the Los Angeles area, including a primary care network and a number of hospitals.

Lead plaintiffs accused the institution of failing to adequately protect information it obtained from patients, allowing hackers to access sensitive and personal information.

According to the class action lawsuit, the UCLA Health Network was subject to a cyber-intrusion incident possibly affecting up to 4.5 million current and former patients.

On July 17, 2015, the board of Reagents issued a notice of the UCLA Health data breach. Plaintiffs alleged that, in failing to protect their and other Class Members’ personal information, the UCLA Health Network violated California consumer privacy and protection laws.

The UCLA Health data breach sparked a number of class action lawsuits, which were consolidated in October 2015.

UCLA Health agreed to complete a number of actions to settle the class action lawsuit: First, Class Members can sign up for free identity protection services through the settlement. Additionally, UCLA Health has agreed to reimburse Class Members for expenses they incurred attempting to protect themselves from or for losses they suffered due to identity theft and fraud due to information exposed in the data breach.

Further, the health network has agreed to update its cybersecurity policies and practices as a part of the UCLA Health data breach class action settlement.

The enroll in identity theft protection, Class Members must submit a Claim Form with their claim ID number by Sept. 16, 2019.

To submit a claim for preventative measures, Class Members must submit a Claim Form along with documentation of expenses by June 18, 2019.

Those who are submitting claims for unreimbursed losses have until June 18, 2021 to do so.

Class Members have until May 20, 2019 to object to or exclude themselves from the UCLA Health data breach class action settlement.

Who’s Eligible

Class Members include “[a]ll persons whose personal information was stored on the portions of the UCLA Health Network that were, or could have been, accessed during the cyberattack disclosed around July 17, 2015, including those who received mail notification of the Incident from UCLA Health in 2015.”

Potential Award

Two years of identity theft protection through ID Experts.

Up to $5,000 for costs incurred preventing identity theft or fraud. 

Up to $20,000 for losses or damage caused by identity theft or fraud. 

Proof of Purchase

Claim ID number for identity theft protection. Documentation of costs or losses for reimbursement claims.
