TracFone Wireless agreed to a class action lawsuit settlement to resolve claims that it failed to prevent a 2021 data breach that compromised consumer information.
The TracFone Wireless settlement benefits anyone whose information was accessed in the TracFone data breach that occurred in December 2021.
According to the TracFone Wireless data breach class action lawsuit, the cellular company failed to protect consumers from the cyber attack due to its inadequate cybersecurity measures. The plaintiffs in the case say that TracFone could have prevented the breach through reasonable cybersecurity measures.
TracFone Wireless is a prepaid phone service that offers plans under several brands, including Straight Talk, Simple Mobile, Net10 Wireless, Walmart Family Mobile and Total Wireless.
TracFone hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve these allegations.
Under the terms of the TracFone Wireless settlement, class members can receive reimbursement for ordinary and extraordinary expenses related to the data breach.
Ordinary expense reimbursement is capped at $3,250 per person. Ordinary losses include bank fees, credit-related costs, communication charges and up to 15 hours of lost time at a rate of $30 per hour. Class members can also receive up to $50,000 in extraordinary expense reimbursement for documented out-of-pocket losses related to identity theft, fraud or lost business opportunity costs.
In addition to receiving reimbursement, class members can receive three years of free credit monitoring services through the settlement. These services include one-bureau credit monitoring and $1 million in identity theft insurance.
TracFone also agreed to make changes to its data security to better protect consumer information. The company will implement new security measures, employee training and other improvements.
The deadline for exclusion and objection is July 8, 2025.
The final approval hearing for the TracFone Wireless data breach settlement is scheduled for Sept. 16, 2025.
In order to receive settlement benefits, class members must submit a valid claim form by Aug. 7, 2025.
Who’s Eligible
Consumers who were current or former TracFone Wireless customers, including customers of Straight Talk, Simple Mobile, Net10 Wireless, Wal-Mart Family Mobile and Total Wireless, whose information was accessed in the data breach occurring on or before December 2021.

Claimants must provide documentation to support their claims, such as receipts, bank statements, invoices, phone bills, credit reports, police reports, identity theft reports, etc.
