A $25 million Terminix settlement has been reached to resolve claims in a Terminix class action lawsuit that the company charged customers high renewal prices for termite protection and falsely advertised its services.
The settlement benefits both former and existing Terminix customers in Alabama.
The Terminix class action lawsuit, filed by the Alabama attorney general, alleged the company had violated state law by failing to perform adequate initial termite treatments on customersโ structures, then misrepresenting or failing to tell customers about the nature of the treatment; failing to perform annual inspections as required; failing to provide no-cost re-treatments as necessary; subjecting customers to large price increases in 2019 with no increase in service; failing to handle claims of termite damage in a timely and compliant manner.
The Terminix renewal price class action also accused the company of false advertising.
Terminix Renewal Class Action Lawsuit Settlement Benefits
Under the Terminix class action settlement agreement, existing Terminix customers in Mobile or Baldwin counties, or in areas serviced by the Monroeville, Alabama, office, who have not had their property retreated by Terminix in the last seven years are entitled to receive a free re-treatment.
Existing customers in Mobile or Baldwin counties who paid an increased annual renewal price for termite protection in 2019 and 2020 may be entitled to a refund.
Former Terminix customers in those counties who cancelled their contract with Terminix in 2019 or 2020 may be entitled to either a one-time payment of $650, or a reinstatement with Terminix at their 2018 price, as well as a free termite treatment.
Existing and former customers in Alabama who own a Terminix-serviced property they believe contains termite damage may also be entitled to payment for those damages.
In addition to the monetary relief provided in the Terminix renewal lawsuit settlement, the company also has agreed to a seven-year payment increase cap limiting its contract increases to 5 percent plus the Consumer Price Index.
Existing customers seeking refunds do not have to submit a claim form. The Receiver โ a neutral third party acting as an agent of the Court โ will compute and send the refund.
Former customers must complete sections 1 and 2 and the Attestation section of the claim form.
Existing or former customers wishing to make a claim for property damage must complete sections 1 and 3, as well as the Attestation section.ย
Class Members should not send property damage claim forms to the receiver unless they have first attempted to resolve the dispute with Terminix.
The Terminix settlement fund will terminate Dec. 1, 2022.

Terminex canceled us then said they would send my money back still have not received iresent or my money I peony my house treated. We have had terminex since we built our house in 1995
I paid for service last year in March. Did not receive any service. I have been calling since October. They keep saying I will get a refund. Last reply from them on text 4 March this year. Still waiting for my full refund.

I completed the proper forms with copy of letters submitted to the CEO of Terminix in 2019 and our policy number to the address provided in Florida over three weeks ago and no reply . The claim was for the one time payment .
