Sunrun has reached a settlement over marketing calls.

Solar panel maker Sunrun has agreed to pay up to $5.5 million to settle a class action lawsuit alleging the company made illegal marketing calls.

Class Members eligible to benefit from this settlement are U.S. citizens who, between Sept. 1, 2018, and Sept. 25, 2020, received one or more calls or text messages on their cellphone that were placed using a dialing platform from Sunrun or from or on behalf of Media Mix, RMC, or Americor in an effort to generate Sunrun leads or customers. Eligible Class Members also include those who received at least two telemarketing calls or texts from the same companies during a 12-month period while their phone number was on the National Do Not Call Registry. The number must have appeared on the registry for at least 31 days before the calls were received.

The amount each Class Member will receive will vary.

Consumers who file a valid Claim Form that is approved will receive a single payment, the amount of which will depend on the number of Class Members submitting valid claim forms.

The lead plaintiff in the Sunrun class action lawsuit, William Loftus, filed his complaint in March 2019, arguing the San Francisco-based company made repeated robocalls in an effort to sell solar panels.

These calls allegedly violated the federal Telephone Consumer Protection Act (TCPA) passed by Congress in 1991 to restrict the use of automatic dialing systems and require anyone making solicitations by phone to maintain do-not-call lists.

According to Loftus, Sunrun used these automatic dialing systems to target numbers listed on the National Do Not Call Registry.

In his complaint, Loftus said he had never given his phone number to Sunrun, nor did he consent to receiving calls from the company. He also says he did not consent to having any such calls recorded.

He also alleged he had received at least eight calls from Media Mix, seven in September 2018 and one in January 2019.

Loftus claims he answered the January 2019 call and heard the click and pause that can indicate an automatic dialing system was used to place the call.

Following that call, Loftus says, he contacted Sunrun on multiple occasions to ask them to stop calling him; however, he allegedly continued to receive calls from the company.

Sunrun has denied any wrongdoing.

According to the settlement agreement, Sunrun maintains it has complied with the TCPA, the California Invasion of Privacy Act and all other applicable laws. 

In addition, the company disputes Loftus’ claim that Media Mix or other third parties placed calls or sent text messages on its behalf, and says it is not responsible for calls or texts from third parties.

Though Sunrun denies the allegations against it, the parties have agreed to the settlement in order to avoid the risks and costs associated with continuing litigation.

A final hearing in the case is scheduled for May 6, 2021.

The deadline for consumers to file a claim in the Sunrun class action settlement is Jan. 28 2021.

Who’s Eligible

    Wow it’s sad how a lawsuit will happen over telemarketing calls but not over real scams by Sun run?

      I have sunrun on as my solar and in the 6 months I’ve had them I’ve not received any credits I’m billed by them and my original electric company because they are not receiving any production now I have 14 days to pay sunrun or I’ll have to pay 67k for not keeping my end of the contract however they refuse to send a technician out to help figure out why the it’s not producing production to the grid. I feel the pain if getting had by sunrun and no one will help.
