Spartan Mosquito false advertising $3.6M class action settlement

AC2T agreed to a $3.6 million settlement to resolve a class action lawsuit claiming that its Spartan Mosquito Eradicator and Pro Tech products were falsely advertised as able to “eradicate” mosquitoes.

The settlement benefits consumers who purchased Spartan Mosquito, Mosquito Eradicator and Spartan Mosquito Pro Tech products between Dec. 21, 2016, and Aug. 2, 2023.

AC2T’s Spartan Mosquito products allegedly promised to “eradicate” mosquitoes for up to 90 days and kill the pests for up to 30 days. Plaintiffs in the false advertising class action lawsuit argue that there was no evidence to back up these claims.

Spartan Mosquito Pro products are manufactured by AC2T.

AC2T hasn’t admitted any wrongdoing but agreed to a $3.6 million settlement to resolve the false advertising class action lawsuit.

Under the terms of the Spartan Mosquito settlement, class members can receive a cash payment based on the number of products they purchased and whether they can provide proof of purchase for their claims.

Tier 1 claimants who do not have proof of purchase can claim up to one product for $7. Tier 2 claimants who have proof of purchase that shows the purchase price paid can receive a full refund of all the products they purchased. Tier 3 claimants who have proof of purchase that does not show the purchase price paid can receive $10 per product purchased.

The deadline for exclusion and objection is Dec. 1, 2023.

The final approval hearing for the Spartan Mosquito Eradicator class action lawsuit settlement is scheduled for June 26, 2024.

To receive a settlement payment, class members must submit a valid claim form by Dec. 1, 2023.

Consumers who purchased Spartan Mosquito, Mosquito Eradicator and Spartan Mosquito Pro Tech products between Dec. 21, 2016 and Aug. 2, 2023
