A settlement has been reached in a class action lawsuit alleging PVH Corp. violated the Fair Labor Standards Act and California labor laws with regard to fees incurred using the Money Network Payroll Distribution Service.
If you are a current or former employee who worked for PVH Corp., PVH Retail Stores LLC, PVH Wholesale New Jersey, Inc., PVH Neckwear Inc., PVH Wholesale Corp., PVH Puerto Rico Inc., PVH Guam Inc., Calvin Klein Inc., Tommy Hilfiger USA Inc., Tommy Hilfiger Retail LLC, Warnaco Inc., Warnaco Group Inc., Warnaco US Inc. or Warnaco Swimwear Products Inc., you may be entitled to benefits from the class action settlement.
The class action lawsuit took issue with fees incurred by employees using the Money Network Payroll Distribution Service. Under the terms of the class action settlement, eligible Class Members will be entitled to a full refund of the fees they paid.
The defendants deny any wrongdoing but agreed to settle the class action lawsuit to avoid the expense and uncertainty of ongoing litigation. They have agreed to pay a total of $725,000 to resolve the litigation.
The PVH Corp. class action settlement was preliminarily approved on Aug. 7, 2015.
Who’s Eligible
If you belong to one of the following three Classes, you are a Class Member of the PVH Corp. class action settlement.
California Settlement Class: Includes (a) all current and former employees who worked for Defendants in California from July 17, 2014 through Aug. 7 2015 and who were paid wages at any time after July 17, 2014; and (b) all current and former employees who worked for Defendants in California from March 20, 2009 through Aug. 7, 2015, who were paid wages at any time via the Payroll Distribution Service, and who affirmatively opted-out of the settlement in Chavez v. PVH Corp., et al.
FLSA Settlement Class: All current and former non-exempt employees who worked for Defendants in the United States and U.S. territories, other than California, from Oct. 25, 2010 through Aug. 7, 2015 and who were paid wages at any time via the Payroll Distribution Service.
Nationwide Settlement Class: All current and former employees who worked for the Defendants in the United States and U.S. territories, other than California, from Oct. 25, 2009 through Aug. 7, 2015 and who were paid wages at any time via the Payroll Distribution Service.
Potential Award
Varies. Under the terms of the class action settlement, Class Members are entitled to a payment of 100 percent of all fees or charges they incurred as a result of use of the Money Network Payroll Distribution Service.
