Californian consumers who made a mortgage payment via interactive voice response (IVR), telephone, or the internet through PNC Bank and paid fees may be eligible to receive compensation thanks to a recent $661,793.51 class action settlement.
Settlement Class Members include consumers who made a mortgage payment through the internet, by telephone, or via IVR through PNC Bank and were charged fees between June 22, 2016, and March 16, 2021.
Per the class action lawsuit, the plaintiffs allege PNC charged them fees in order to make certain specific mortgage payments that were made on a residential property in California. According to the Plaintiff, charging these fees was a violation of California’s Rosenthal Act and Unfair Competition Law.
PNC Bank has branches in 28 states, according to its website.
The company denies any wrongdoing and denies breaking any laws. On top of that, PNC denies any liability regarding this issue.Â
The Court allowed the class action lawsuit to proceed, but did not make any ruling regarding guilt in this matter. Rather, both the plaintiff and the company have determined that agreeing to the proposed settlement agreement is in the best interests of everyone involved.
About $388,255.46 will be distributed to eligible Class Members who do not opt out of the settlement, according to the class action settlement.Â
The exact amount of compensation that each Class Member receives hinges on the amount in fees they paid to PNC between June 22, 2016, and March, 16 2021, when making mortgage payments.
Class Members have the option of excluding themselves from the settlement. By doing so, they will not be eligible to receive their share of the settlement fFunds, but they will retain the right to pursue future lawsuits regarding this matter. Exclusion requests must be filed by Dec. 8, 2021.
Class Members who want to be included in the Settlement Class but do not agree with the terms of the settlement agreement have the right to file an objection by Dec. 8, 2021.
Class Members who do not take action will stay in the lawsuit and continue to be a part of the settlement Class.Â
Once the Court grants final approval, these Class Members will receive their share of the settlement fund. Class Members will be bound by the terms of the agreement and will not be able to seek out future litigation regarding this matter.
A final approval hearing is scheduled to take place Jan. 24, 2022.
