Petco Employee Background Check Class Action Settlement

Petco Animal Supplies Inc. has agreed to pay $1.2 million to settle a class action lawsuit alleging it violated the Fair Credit Reporting Act by procuring consumer reports for employment purposes without the proper disclosure and without obtaining proper authorization.

If Petco procured a consumer report on you between May 1, 2014 through Dec. 31, 2015, you may be entitled to payment from the Petco FCRA class action settlement.

The Petco class action lawsuit was filed by plaintiffs Jacklyn Feist and Angelica Zimmer in San Diego Superior Court on May 5, 2016, and was removed to California federal court one month later.

Feist and Zimmer allege Petco procured consumer reports on them and other Class Members for employment purposes without providing a stand-alone disclosure as required under the FCRA.

The Petco class action lawsuit also alleges Petco failed to provide a pre-adverse action notification letter to certain Class Members against whom the company took adverse action based on information contained in the consumer report.

Petco does not admit any wrongdoing but the company agreed to settle the FCRA class action lawsuit and avoid the risk, uncertainty, burden and expense of ongoing litigation.

The Petco FCRA class action settlement was preliminarily approved on June 11, 2018.

Approximately 37,300 Class Members may be eligible for benefits from the Petco class action settlement.

Class Members who would like to opt out of or object to the Petco background check settlement must do so no later than Sept. 24, 2018.

Who’s Eligible

Class Members of the Petco FCRA settlement include anyone on whom Petco procured consumer reports from May 1, 2014 through Dec. 31, 2015 (Disclosure Class Members).

A subset of Disclosure Class Members may also be members of the Adverse Action Class. This Class includes individuals against whom Petco took adverse action on the basis of information included in the consumer report.

Potential Award

$21 (estimated).

Approximately 52 individuals included in the Adverse Action Class will receive an additional payment of $150.

Claim Form Deadline

N/A. No Claim Form is required to receive benefits from this Petco class action settlement.
