Ocean Spray has agreed to pay $5.4 million to resolve claims that some of their juices are falsely advertised as containing “no artificial flavors.”
The settlement benefits individuals who purchased certain Ocean Spray products between Jan. 1, 2011 and Jan. 31, 2020. A full list of included products is available in the “Who’s Eligible” section below.
In November 2017, plaintiffs filed an Ocean Spray class action lawsuit alleging that the company wrongfully represented their products as containing “No High Fructose Corn Syrup, Artificial Colors or Flavors.” These advertisements were allegedly false and made to deceive consumers into purchasing the products.
The plaintiffs claim Ocean Spray juice products contain a synthetic ingredient known as malic acid. Malic acid produces a tart flavor in food. Although there is a naturally derived form of malic acid, the Ocean Spray class action asserts that the juice products used the synthetic form of malic acid derived from petrochemicals.
Ocean Spray agreed to resolve the claims against them in a $5.4 million settlement, although the company has not admitted to any wrongdoing.
The settlement will provide $1 in cash for each bottle purchased. Up to 20 bottles can be claimed by a household, for a maximum payment of $20.
In order to benefit from the settlement, Class Members need to file a valid claim form by July 10, 2020. The deadline for exclusion and objection is July 1, 2020. The final approval hearing for the Ocean Spray class action settlement is scheduled for July 31, 2020.
Who’s Eligible
Individuals who purchased certain Ocean Spray products between Jan. 1, 2011 and Jan. 31, 2020.

The settlement has been approved by the court. There is now a 30 day period during which the case may be appealed. If the case is not appealed, we expect to start sending out payments in approximately 60 days.
