Oak Valley Hospital agreed to a class action lawsuit settlement to resolve claims a 2023 data breach exposed the personal information of current and former patients.

The Oak Valley Hospital settlement benefits individuals who received a data breach notice from Oak Valley Hospital concerning the 2023 cybersecurity incident discovered on or about July 18, 2023.

The class action lawsuit involves an Oak Valley Hospital data breach that occurred between April 21, 2023, and July 18, 2023, during which unauthorized third parties gained access to certain files containing the personal information of current and former patients. According to plaintiffs in the case, Oak Valley Hospital District failed to take action to protect patients from data breaches and is therefore responsible for the increased risk of identity theft stemming from the incident.

Oak Valley Hospital is a hospital in Oakdale, California.

Oak Valley Hospital hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.

Under the terms of the Oak Valley settlement, class members can receive two forms of payment: a residual cash payment and a reimbursement payment. Even without documented losses from the Oak Valley Hospital data breach, class members can receive a residual cash payment of $100. Residual payment amounts may increase or decrease based on the number of claims and available funds. Class members can also claim up to $5,000 in reimbursement for documented ordinary out-of-pocket losses and up to three hours of lost time at $30 per hour.

In addition to providing these monetary benefits, Oak Valley agreed to enhance the security measures used on its data network to better protect patient information.

The deadline for exclusion and objection was Sept. 30, 2024.

The final approval hearing date is Dec. 19, 2024.

To receive data breach settlement benefits, class members must submit a valid claim form by Nov. 19, 2024.
